401 Water Quality Certification, Agency Review Extension Authorization

Dear Mr. Dorney:
The following letter is to confirm our February 28, 2008 phone conversation regarding the Bridgewater
Powerhouse Construction Project - 401 Water Quality Certification (WQC) Application (DWQ No.
071868 Ver. 2). As we discussed, the 401 WQC application was submitted to the North Carolina
Division of Water Quality (DWQ) on December 28, 2007. Although the 60 day DWQ review period has
been exceeded, on behalf of Duke Energy Carolinas (Duke Energy), Devine Tarbell & Associates (DTA)
authorizes an extension of the review period until March 7, 2008. We feel that this extension is in
keeping with Duke Energy's long history of agency cooperation on projects of both large and small scale,
and will serve to continue building our positive relationship with the DWQ.
With that in mind, we would ask that the Project timetable be given some measure of deference and that
the 401 WQC be issued without schedule impacting conditions. Also, we appreciate your clarification of
the Catawba River Buffer Rules as they apply to this unique project, specifically that Project impacts to
the riparian buffer are allowable without mitigation.
