Sullins, Director Division of Water Quality February 21, 2008 DWQ Project No. 05-0578 Guilford County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Sister Lucy Hennessey Pennybyrn at Maryfield 1315 Greensboro Road High Point, NC 27260 Subject Property: Pennybyrn at Maryfield APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Sister Hennessey: On November 15, 2005, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact 506 linear feet of stream and 0.09 acre of forested wetland in order to construct the Pennybyrn at Maryfield development. Condition number 8 of the General Certification required the submission and approval of a stormwater management plan for this project. On February 24, 2006, the DWQ received a stormwater management plan prepared by the consulting engineer, Mr. Monte J. Moreschi of Kootz-Bryant, P.C. This stormwater plan was approved by the DWQ on February 28, 2006. On January 25, 2008, the DWQ received a revised stormwater management plan, dated January 23, 2008, submitted by the consulting engineer Mr. Monte J. Moreschi of Kootz-Bryant, P.C. This revised stormwater management plan has been reviewed and satisfies the stormwater management requirements of the 401 Water Quality Certification. The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all storm water conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
