This permit, issued on February 18, 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in compliance with the attached list of workplan drawings: sheet number 1 dated 7/2/07, sheet 5 of 26 dated revised 1/12/07, sheet 6 of 26 dated 5/10/06, sheet 7, and 18 of 26 dated 3/13/07, sheet 7B, and 18a of 26 dated revised 4/4/07, sheet 8 of 26 dated revised 2/8/07, sheet 9 of 26 dated revised 11/21/06, sheet 10, 14, and 17 of 26 dr:ted revised 1/12/07, sheet 11, 12, 13, 15, 16, 20, 21, 22, and 23 of 26 dated revised 11/21/06, sheet 19 c~ 26 dated revised 9/14/06, sheet 24 of 26 dated 3/3/06, sheet 25 of 26 dated 3/6/06, sheet 26 through 2bd of 26 dated 5/2/06. (See attached sheets for Additional Conditions) FED ~ 1 2008 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit # 6-OS Page 2 of 5 ADDITIONAL CONDITIONS Canoe/Kayak Launch and Crabbing Piers 2) In order to comply with 15A NCAC 07H.0208, the platforms for the canoe kayak launch and the crabbing piers shall be constructed as follows: the covered platform associated with the, crabbing pier represented in the attached workplan drawing as sheet 10 of 26 dated revised 1/12/07, cross section A which is proposed entirely over Coastal Wetlands, shall not exceed a width of 6 ft. which will result in a platform size of 28 ft. x 6 ft. The covered platform associated with the, crabbing pier and canoe/kayaking facility represented in the attached workplan drawing as sheet 11 of 26 dated revised 11/21/06, cross section B, shall have no section of the covered platform located over Coastal Wetlands, which will result in a platform size of 24 ft. x 6 ft. The covered platform associated with the crabbing pier represented in the attached workplan drawing as sheet 14 of 26 dated revised 1/12/07, cross section C, shall have no section of the platform located waterward of any Coastal Wetlands, which will result in a platform size of 35 ft. x 6 ft. located entirely over Coastal Wetlands. The covered platform associated with the crabbing pier represented in the attached workplan drawing as sheet 17 of 26 dated revised 1/12/07, cross section D, shall have no section of the platform located waterward of any Coastal Wetlands, which will result in a platform size of 40 ft. x 6. ft located entirely over Coastal Wetlands. 3) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water as set forth in Condition No. 2 of this permit. No other structure, whether floating or stationary, shall become a permanent part of these facilities without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 4) All portions of the access piers located over Coastal Wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 3 feet above the Coastal Wetland substrate as measured from the bottom of the decking. 5) The authorized canoe/kayak launch shall not extend more than 1/a of the width of the waterbody, as measured from the waterward edge of the marsh on both sides of the waterbody in front of the project site. 6) In order to ensure compliance with Condition Nos. 2 and 5 of this permit, an as-built survey showing the dimensions and locations of the authorized structures, and the distance across the water body shall be performed on the facilities, and copies of the survey shall be provided to the the Division of Coastal Management, within 60 days of completion of construction. NOTE: Failure to provide the survey required in Condition No. 6 shall result in a violation of this permit. 7) The authorized covered platforms as modified in Condition No. 2 shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and watei. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 8) The roof of the covered platforms shall not be designed for second story use. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. ?BIAS Properties LLC & Seawatch at Sunset Harbor Inc. Permit # 6-08 Page 3 of 5 ADDITIONAL CONDITIONS 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he .abandons the permitted activity without having it transferred to a third party. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. 13) This permit does not authorize the creation of any formalized boat slips. The installation of any tie- downs, mooring pilings, boat whips, or other formalized moorings are not authorized and any proposal for such structures shall require further review and a modification of this permit. Upland Development 14) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including but not limited to all roads, screened shelter with restrooms, a canoe storage building, the concrete parking area, and infrastructure associated with the development of the subdivision, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Brid e 15) Unless specifically altered herein, this permit authorizes the bridge all as expressly and specifically set forth in the attached permit application and workplan drawings. Any proposal to change the location of the bridge may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. Sedimentation and Erosion Control 16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Permit # 6-08 Page 4 of 5 ADDITIONAL CONDITIONS 17) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Nlana~ement 18) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8040614 on 12/3/07. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 19) The authorized project is located within a designated Primary Nursery Area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 21) No open water areas or vegetated wetlands shall be excavated or filled, even temporarily. 22) The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in the tidal waters of Brunswick County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" shall be followed. NOTE: NOTE: NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. The N.C.
