Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in compliance with the attached list of workplan drawings: sheets 1, 2A, 3, and 4 of 7 dated "revised 9/24/07", sheet 2 of 7 dated "revised 9/25/07", and sheets 5 and 6 of 7 dated "revised 8/2/07". (See attached sheets for Additional Conditions) This permit action may be appealed by the pernuttee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case maybe. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2011 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee RJP Newport Corporation ADDITIONAL CONDITIONS Archaeological Assessment Permit #,10-08 Page 2 of 4 2) Prior to initiation of any ground disturbing activities within the project area, the permittee shall arrange for a comprehensive archaeological survey and evaluation of the entire project area of approximately 7.25 acres. A professional archaeological consultant shall undertake this work. The purpose of this survey will be to locate archaeological sites within the project area and assess them all in terms of the National Register of Historic Places (NRHP). If any site is determined to be eligible for the NRHP the permittee shall determine whether the site will be adversely affected by the project activities; and, if so, to develop and implement an appropriate mitigation plan. All activities associated with the archaeological investigations shall be conducted in close coordination with the Office of State Archaeology (OSA). Two copies of all resulting archaeological reports, as well as one copy of the updated site form, should be forwarded to the Office of State Archaeology for review and comment as soon as they are available and in advance of any construction or ground disturbance activities. Written notice from the OSA of the satisfactory completion of this condition shall be submitted to DCM prior to initiation of any development activities authorized by this permit. Upland Development 3) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including but not limited to all roads, utilities, and infrastructure associated with the development of the 1 S-lot subdivision, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this determination. Wetland Disturbance 4) No Coastal Wetlands shall be disturbed outside the areas indicated on the attached workplan drawings associated with the placement of the 8-inch sewer main. 5) All disturbed Coastal Wetland areas shall be returned to pre-project contours immediately after the installation of the sewer main. 6) Due to the possibility that compaction, mechanized clearing and/or other site alterations might prevent the temporary Coastal Wetland impact areas from re-attaining pre-project wetland functions, the permittee shall provide an annual update on the Coastal Wetland areas temporarily impacted by this project. This annual update shall consist of photographs and a brief written report on the progress of these temporarily impacted areas in re-attaining their pre-project conditions. Three years after project completion, the permittee shall hold an agency field meeting with the N.C. Division of Coastal Management (DCM) to determine if the wetland areas temporarily impacted by this project have re- attained pre-project wetland functions. If at the end of three years the wetland areas temporarily impacted by the project have not re-attained pre-project wetland functions, DCM will determine whether compensatory wetland mitigation shall be required. RJP Newport Corporation ADDITIONAL CONDITIONS Culvert Placement Permit # 10-08 Page 3 of 4 7) The placement and alignment of the authorized culvert shall adhere to that depicted on the attached workplan drawings. Any proposal to alter the placement or alignment may require a modification of this permit. Contact a Division representative at (252) 808-2808 for this determination. 8) This permit does not authorize the excavation of ditch bottom other than that necessary to set the culvert. 9) Appropriate bedding material must be placed beneath the culvert to prevent structural subsidence. NOTE: Should the adjacent property in which the culvert is to be placed is sold prior to the placement of the culvert on the property, the permittee shall be required to obtain a signed waiver from the new property owner prior to the placement of the culvert on their property. Sedimentation and Erosion Control NOTE: The N.C. Division of Land Quality approved this project under Permit No. Carte-2007-434 on 5/25/07. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 11) The N.C. Division of Water Quality approved this project under Stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8070507 on 5/18/07. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 12) Any future lot owner that has riparian rights and desires to construct a pier or dock shall be required to submit a Major Development Permit Application to the Division of Coastal Management for thorough state and federal review, providing in addition to the typically required information, all existing docks within the subdivision, location of all oyster rock, width of the water body, and professionally surveyed water depths. NOTE: The authorized project is located adjacent to a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted development, with the exception of a rule change. RJP Newport Corporation ADDITIONAL CONDITIONS Permit #, 10-08 Page 4 of 4 13) The waters downstream of the permitted project are classified as "Conditionally Approved". The construction and/or operation of the authorized subdivision shall not directly result in a permanent closure of these conditionally approved waters. Any such permanent closure directly attributable to the authorized subdivision shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, mitigative measures to reduce or eliminate the cause(s) of the closure. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that maybe required, which includes but is not limited to any Access Permits required by NC DOT . NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3631 (DWQ Project No. 071873), which was issued on 12/28/07. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under NW18 (COE Action Id. No. SAW-2006-00576-010) which was issued on 12/19/07.
