Talked to Kevin this AM and he has indicated that they will resubmit
and not impact wetland and "perennial" stream with instream retention
pond. They will still impact several linear feet of stream (non
perennial, in my opinion) so no mitigation. They are to send new
notification to you and me.

Please place on hold. Waiting for a determination on actual size
requirements for proposed wet retention pond stream impacts plus a
determination as to whether or not wetland impacts can be avoided.
This was a wild one from the perennial picture as it appears that the
waters between ponds will dry up during the dry season. This would
not have been the case prior to golf course ponds being constructed,
in my opinion. High Point only requires a 20' buffer on their WQ
ponds. They were also proposing to divert water from last pond.
Both Kevin and I urged them not to do this. Kevin is getting tough
to deal with in the field. Keeps us on our toes though.
