(SEGi), on behalf of Thornbrooke Holdings, LLC (herein referred to as the "Applicant") is submitting the attached Department of the Army (DoA) Individual Permit (IP) Application and accompanying appendices (see Attachment 1). The application is required to secure US Army Corps of Engineers (USACE) and Division of Water Resources (DWR) authorization to impact 0.07 -acre of waters of the US, on property located within the existing Forest Hills at Hampstead subdivision. This subdivision was started in 2007, by Legend Builders, as Hoover Road Subdivision, but was foreclosed upon and later purchased by the Applicant. In 2008, a Nationwide Permit 29 and corresponding Water Quality Certification 3705 were issued (see Attachment 2). The permits authorized the fill of 0.49 -acre of US Section 404 wetlands, which was necessary to facilitate the construction of Trenney Lea Drive, the main entrance road into the subdivision. As mitigation for the impacts, Legend Builders was to make payment to the NC Ecosystem Enhancement Program (NC EEP), for 1.0 -acre of non -riparian wetland restoration credit. In addition, restrictive covenants and accompanying preservation map were to be recorded at the Pender County Register of Deeds. To date, the authorized impacts have taken place and the NC EEP payment has been fulfilled (see Attachment 3), but the restrictive covenants and preservation map have not been recorded. The Applicant purchased the property in 2015, with the vision of creating an equestrian friendly subdivision. The lots would need to be large enough to accommodate stables, barns and pastures, as well as residential dwellings. However, large upland areas are cut off by wetlands on four lots. Therefore, the Applicant is seeking to impact 0.07 -acre of riparian wetlands (i.e. Headwater Forest), for the purpose of providing access to uplands with lot numbers 7, 9, 10 and 20. The road crossings have been strategically situated to cross wetlands at the narrowest points and perpendicular to the wetland features, as well as narrowing the width of the crossings to 10 foot through wetlands, thus reducing impacts to the greatest extend practicable. Cumulatively with those impacts authorized in 2008, the project will impact 0.56 -acre of USACE Section 404 wetlands. Alternatives such as bridging and abandoning the impacts were examined, but were determined to be impracticable. The Applicant proposes to offset the unavoidable loss of 0.07 -acre of riparian wetland function, by 5EGi making payment to the Northeast Cape Fear Mitigation Bank for 0.20 -acre of riparian wetland restoration credit (i.e. mitigation to impact ratio of 2:1). The proposed plan allows the Applicant to utilize buildable uplands and is believed to be the least environmental damaging, practicable alternative. In summary, the Applicant is seeking the agencies' authorization to impact 0.07 -acre of riparian wetlands, within the existing Forest Hills at Hampstead subdivision, for the purpose of installing access drives to uplands located within four lots. In addition, the Applicant is requesting to remove the requirements of Condition #2, of the previously issued NWP. As part of the Individual Permit process, SEGi applied the Section 404(b)(1) guidelines, by utilizing historical aerial photography and available current land use records, to best determine if any off-site alternatives existed Thornbrooke Holdings, LLC (herein referred to as the "Applicant") purchased the subject property for several reasons. First, the access roads and utilities had already been installed. Second, the property was large enough to subdivide into individual lots that could accommodate a single family dwelling, barns and pasture areas. Third, the property is in an area where sewer and water lines have been installed and was zoned adequately (i.e. Residential Performance or Rural Agriculture). And lastly, the location of the property was in close proximity to Highway 17, shopping centers, schools and an area with good employment opportunity. A. Off-site Alternative Analysis Considering the purpose of the project, multiple sites were reviewed. These sites and their ability to meet the required criteria are discussed below. 1. Alternative Site 1 — Parcel ID: 3238-51-7542-0000 This site met most of the Applicant's desired criteria, but from looking at the Pender County National Wetland Inventory (NWl) map, it appears wetlands consume most of the parcel. It is anticipated that a significant amount of wetland impacts, above what is being proposed, would be necessary to achieve the Applicant's stated goal. This site must also be purchased, which would make the project economically infeasible. Therefore, Alternative Site I was rejected. 2. Alternative Site 2 — Parcel ID: 3293-01-5693-0000 This site appears to meet most of the Applicant's criteria, but the property is not available for purchase. Therefore, this site was rejected. 3. Alternative Site 3 & 4 — Parcel ID: 3282-28-1109-0000 This site appears to meet most of the Applicant's criteria, but the property would have to be purchased, and therefore is not a practicable alternative. 4. Alternative Site 5 — Parcel ID: 3283-93-8856-0000 Forest Hills at Hampstead Altemative Analysis SEGS This site, similar to Alternative Site 3, does not have sewer and water available and the site must be purchased. This makes this site infeasible, and therefore, was rejected. B. On -Site Alternatives Analysis During the design of the project, several on-site alternatives were considered. 1. Alternative l — Current Proposed Design: This alternative was designed to utilize as much of the uplands within the property as possible, while impacting the least amount of wetlands. Alternative 1 was accepted as it was the least environmentally damaging practicable alternative. Alternative 2 — Bridging the Wetlands. This alternative was explored, but due to the minimum bridge height requirements (i.e. 3' above the substrate, where crossing wetlands), the structures would have been too expensive to construct. Therefore Alternative 2 was refected due to economic feasibility. 3. Alternative 3 — "No Action". Not providing access to the upland areas within the four (4) lots would re- move the ability for the Applicant to market or utilize the lots as equestrian home sites, which would re- sult in a loss of return on the Applicant's investment. Alternative 3 was rejected, as it would prohibit the Applicant from achieving the desired project goals and create an economic hardship for the Applicant. Based on the results of the on-site and off-site Alternative Analysis, it is apparent that on-site Alternative 1 is the least environmentally damaging practicable alternative. C. Mitigation for Unavoidable Impacts to Waters of the US The Applicant believes the proposed site and plan is the LEDPA. In order to offset the loss of chemical, biological and physical processes from 0.07 -acre of riparian wetlands, which will be removed as a result of the proposed fill, the Applicant propose to purchase 0.20 -acre of riparian wetland restoration credit from the Northeast Cape Fear Umbrella Mitigation Bank. This bank services the project area and has been a functioning bank for many years.
