Director Division of Water Quality January 30, 2007 CERTIFIED MAIL: RETURN RECEIPT REQUESTED #7005 1820 0003 6594 8495 Mr. Sammy Marshall 233 Robert Jackson Road Bath, NC 27808 Subject Property: Hilton Waters Pamlico River [030307,29-(5), SB, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Marshall: DWQ Project # 06-1703 Beaufort County Page 1 of 2 On October 26, 2006 the Division of Water Quality (DWQ) received your application dated August 4, 2006 to impact 0.0329 acres of vegetated wetlands to construct the proposed bulkhead across the head of a manmade canal and backfill an area of coastal wetland. On November 30, 2006 the DWQ sent you a " Request for more information" letter. On December 15, 2006 the DWQ received your response to that letter. The DWQ has determined that your response was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide the diffuse flow provision measures on the site plan and submit diffuse flow provision measure worksheets (e.g. level spreaders) and a signed and notarized Operations and Maintenance Agreement. Please contact the DWQ within four (4) weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date.
