Director Division of Water Quality November 30, 2006 DWQ Project # 06-1703 Beaufort County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Sammy Marshall 233 Robert Jackson Road Bath, NC 27808 Subject Property: Hilton Waters Pamlico River [030307,29-(5), SB, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Marshall: On October 26, 2006, the Division of Water Quality (DWQ) received your application dated August 14, 2006, to fill 0.0329 acres of vegetated wetland (coastal wetland) to construct a bulkhead across the head of a manmade canal and backfill an area of coastal wetland. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The. DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we.receive this additional information. Please provide five copies of the following information so that we may continue to review your project. Additional Information Requested: 1. Please indicate the diffuse flow provision measures on the site plan and submit diffuse flow provision measure worksheets (e.g. level spreaders) and a signed and notarized Operations and Maintenance Agreement. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date. Please contact me in writing and Kyle Barnes of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Thank You, B ron4 e Y Y U - Lic'm DEC 1 5 2006 etNR - WATER QUALITY *ETLANDS AND STORM•A.TER RRM GH Steve Trowell 943 Washington Square Mall Washington, NC 27889 Dear Mr. Trowell: The project site is located off SR 1737 at 233 Robert Jackson Road, on a man made canal off the Pamlico River near Bath in Beaufort County, North Carolina. The project proposal is to construct 19' of bulkhead across the head of a man made canal, waterward of a sparsely vegetated wetlands, mostly cattails. The project will include work on property owned by Hilton Waters and Samuel Marshall. Enclosed are the applicable application, signed Authorized Agent Consent Agreement, deeds for both properties and certified mail receipt. Once received by me, I will forward to you the signed green cards from the Adjacent Riparian Property Owners for your records. The canal we wish to fill in, has sparsely vegetated wetlands, mostly cattails. The wetlands in the head of the canal are opportunistic growth pioneering on accumulated sediments from upland runoff and erosion from adjacent properties and banks. When construction of the bulkhead is complete and the backfill is in place, storm water drainage will be via sheets flows across a sodded lawn, and a vegetated diverson swale with a rock/gravel sediment trap to prevent and re-entry back into the canal.
