Director Division of Water Quality June 24, 2005 DWQ Project # 04-0165 Wake County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED PS/SE Ballentine, LLC 2514 Reliance Avenue Apex, North Carolina 27539 Subject Property: Ballentine Subdivision, Phases 5, 6 and 7 REQUEST FOR MORE INFORMATION Dear Sir or Madam: On April 22, 2005, the Division of Water Quality (DWQ) received your application dated April 22, 2005 to impact 0.175 acres of wetlands, 139 feet of stream and 14,712 square feet (ftz) of protected riparian buffers to construct the proposed residential subdivision. On May 12, 2005 the DWQ received the Public Notice issued by the US Army Corps of Engineers, Wilmington District. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 213 .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide a complete, detailed breakdown of the assumed built-out conditions including but not limited to footprints of houses, driveways, sidewalks, roads, amenities etc. 2. Please provide an overall drainage plan with topography that includes the locations of all level spreaders. 3. You are proposing a 139' stream crossing with outlet protection however at the end point of the outlet protection the stream shifts direction at an approximate 70 degree angle. The DWQ believes this stream bank may become unstable and/or the stream in this location may redirect itself and cause additional stream impacts. Please address this issue. Please respond within three weeks of the date of this letter by sending this information to me in writing and Eric Kulz of the DWQ Raleigh Regional Office.
