Sullins, Director Division of Water Quality February 28, 2008 DWQ Project # 05-1480, Ver. 2 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jonathan Skinner McCale Development Corporation 729 Thimble Shoals Boulevard, Suite 6-C Newport News, VA 23606 Subject Property: Austin Creek Sewer Line Conector Ut to Austin Creek [030402, 27-23-3, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Skinner: On February 20, 2008, the Division of Water Quality (DWQ) received your application dated January 18, 2008, to fill or otherwise impact 0.2121 acres of 404/wetland, 51 linear feet of intermittent stream, and 0.00 square feet of Zone 1 Neuse River basin protected riparian buffers and 0.00 square feet of Zone 2 Neuse River basin protected riparian buffers to construct a residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide verification from the USACE that they will be permitting your project first under a NW 12 and then later under a NW29. 2. Please re-submit your site plans on full plan sheets at a scale of no smaller than I"=50' with topographic contours. 3. Ultimately it appears your project will be a residential subdivision, therefore, please address the following: a) For any crossing(s) for which a culvert is proposed please provide cross section details showing the provisions for aquatic life passage. b) Please provide the location of any proposed stormwater management practices as required by GC3705. Please include all proposed building footprints, roads, driveways, sidewalks, gravel-surfaced areas, amenity areas, etc. f) Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans. g) Please indicate proposed lot layout as overlays on the site plan. h) Please indicate all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. i) Please indicate all wetland impacts including fill slopes on the site plan. j) Please indicate all riparian buffer impacts on the site plan and clearly label impacts (Buffer Impact 1, etc.). k) Please locate all isolated or non-isolated wetlands, streams, and other waters of the State as overlays on the site plan. 1) Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. m) Please indicate the diffuse flow provision measures on the site plan and submit diffuse flow provision measure worksheets and signed and a notarized Operations and Maintenance Agreement. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
