September 30, 1999 PUBLIC NOTICE The NORTH CAROLINA DEPARTMENT OF TRANSPORTATION (NCDOT), DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina, 27611-5201 has applied for a Department 'of the Army (DA) permit TO DISCHARGE DREDGED OR FILL MATERIAL INTO WATERS OF THE UNITED STATES TO CONSTRUCT THE I-73/74 IMPROVEMENTS BETWEEN THE US 74 BYPASS SOUTH OF ROCKINGHAM (TIP R- RIC ??NNii?? :1231, 512) AND THE US 220 BYPASS SOUTH OF ELLERB (TIP .& COUNTY, NORTH CAROLINA, TIP No.-3421, State Project No. 8.15808IU PROJECT DESCRIPTION: The following description of work is taken from the EA provided by the applicant. A map showing the location of the alternatives under consideration for this project and a table of all the anticipated impacts associated with the proposed alternatives is included with this public notice. The purpose of the proposed project, as concurred by the Corps of Engineers by letter dated December 21, 1998, is to provide a freeway route from US 220 south of Ellerbe, NC to the US 74 Bypass (TIP 112). The freeway will provide a route for the I-73/1-74 corridor and would reduce traffic congestion in Rockingham, North Carolina. The EA evaluated two proposed alternatives as follows: a. Alternative C. Alternative C is an 11.3 mile four-lane divided freeway that extends from the US 74 Bypass (TIP R-512) of Rockingham, presently under construction, to the proposed US 220 (173/174) Bypass (TIP 3421) of Ellerbe. This alternative originated in the Feasibility Study but was modified to avoid the Zion Community Historic District located along SR 1109 (Zion Church Road), south of existing US 74, and to minimize wetland impacts near SR 1304 (Harrington Road). This alternative includes widening 1.8 miles of US 74 Bypass (under construction), construction of 7.1 miles on new location, and upgrading 2.4 miles of existing US 220 to interstate standards. The proposed median width is 70 feet on the new location segment and 60 feet along existing US 220. Specific details on the location and proposed interchanges with this alternative are provided in the EA. 2 b. Alternative A-C. Alternative A-C is a combination of Feasibility Study Alternatives A and C. This alternative is a 9.7 mile four-lane divided freeway that extends from the US 74 Bypass (TIP R-512) of Rockingham, presently under construction, to the proposed US 220 (173/174) Bypass (TIP 3421) of Ellerbe. This alternative includes widening 1.0 mile of US 74 Bypass (under construction), construction of 6.3 miles on new location, and upgrading 2.4 miles of existing US 220 to interstate standards. The proposed median width is 70 feet on the new location segment and 60 feet along existing US 220. Specific details on the location and proposed interchanges with this alternative are provided in the EA. According to the EA, wetland impacts associated with Alternatives A-C and C are summarized in Table (1) below: Table 1. Wetland impacts (acres) for each alternative. Impact acreage's are based on functional design, approximate construction limits, delineated wetlands and type described in the Natural Systems Report (1998). 2. Wetland types are classified in accordance with Cowardin et al (1979). According to the EA, both alternatives will impact streams. Alternative C will cross 29 streams and fill 12,160 feet of stream and 2.3 acres of open water. Alternative A-C will cross 25 streams and fill 11,900 feet of stream and 1.8 acres of open water. The EA states that the need for stream relocation is not anticipated at this phase of the planning process. However, should stream relocations be required in the final design, they will be designed according to the most recent guidelines for open channels and will match existing channel conditions as closely as possible. BACKGROUND: The social, economic, and environmental impacts associated with the two alternatives (Alternatives C and A-C) for this project are described in an Environmental Assessment (EA) released on April 27, 1999. A permit application for the proposed project was received on June 15, 1999. A feasibility study that evaluated preliminary alternatives for the proposed project was published in May 1996. This study identified and evaluated five alternatives that would provide a link between the proposed US 220 freeway near Ellerbe and the US 74 Bypass southwest of 3 Rockingham (presently under construction). The Feasibility Study included three alternatives (Alternatives A, B, and C) located west of existing US 220 and two alternatives (Alternatives D and E) located east of US 220. Alternatives located east of US 220 were considered less viable than alternatives west of US 220. Alternative D was primarily eliminated due to relocations, encroachment on the Hitchcock Creek Critical Watershed Area, and proximity to three 4(f) sites. Alternative E was eliminated due to a lack of optimal interchange spacing along the proposed US 220 Ellerbe Bypass (TIP R-2231), potential impacts on wetlands and the Hitchcock Creek Critical Watershed Area, lack of support from state and federal agencies, and lack of support from the local community. Alternative B, located west of US 220, was eliminated due to high cost, close proximity to a potential 4(f) site and the Richmond County landfill. The two remaining Feasibility Study Alternatives (Alternatives A and C) were selected for further analysis. Alternative A was combined with Alternative C and renamed A-C. A copy of the EA is available for review at the Wilmington Regulatory Field Office of the Wilmington District Corps of Engineers, 69 Darlington Avenue, Wilmington, North Carolina, 28402. In order to compensate for the unavoidable wetland impacts associated with this project, NCDOT is currently investigating mitigation opportunities in the vicinity of the project; however, a mitigation proposal is not ready for review at this time. It is expected that the District Engineer will require an approved final mitigation plan prior to the issuance of any permit for the proposed project. In order to more fully integrate Section 404 permit requirements with the National Environmental Policy Act of 1969, and to give careful consideration to our required public interest review and 404 (b)(1) compliance determination, the Corps of Engineers is soliciting public comment on the alternatives evaluated in the EA. At the close of this comment period, the District Engineer will evaluate and consider the scope of comments received as well as the expected adverse and beneficial impacts of the proposed road construction to select the least environmentally damaging, practicable alternative. The State of North Carolina will review this public notice to decide the need for the applicant to obtain any required State. authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has decided the applicability of a Water Quality Certificate as required by PL 92-500. The requested Department of the Army (DA) permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. - 4 This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 USC 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested. permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based`on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. -The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States; a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic 5 properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental .
