Re: Permit Application for proposed replacement of Bridge No. 23 on Camp Springs Road (SR 1146)
across Line Creek in Caswell County
DWQ No. 020480, TIP No. B-3317
Dear Mr. Mills:
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following areas:
The project as presently proposed calls for replacing a bridge with a culvert. The waters being
impacted are classified as WS II HQW. At this time, and given the present design the NCDWQ
requires additional information prior to issuance if the 401 Water Quality Certification. The present
design will likely result in a,destabilization of the stream. Please provide a design that incorporates a
downstream and upstream rock cross vane at this site, and provide the proposed design specifications
for the cross vane installation. If you believe the requested design changes are problematic, please
provide additional information detailing the engineering rationale, and provide an alternative design
that provides for stream stability.
Therefore, pursuant to 15A NCAC 2h .0507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.

The Wetlands Unit received your response to the request for additional information dated June 14, 2002. Staff reviewed
the information provided and determined that additional information is necessary to establish that the proposed culvert will
not result in destabilization of Country Line Creek. The required additional information is as follows: .
This Office agrees with your statement that the introduction man-made controls would interfere with the natural equilibrium
of this stable stream system. This is why more information and additional measures have been requested by this Office to
ensure that the placement of the proposed culvert that restricts the existing floodway will not destabilize the stream.
General Water Quality Certification No. 3375 Condition No. 9 states in part:
"Design and placement of culverts including open bottom or bottomless arch culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may
result in aggradation, degradation or significant changes in hydrology of wetlands or stream beds or
banks, adjacent to or upstream and down stream of the above structures. The applicant is required to
provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ.
Additionally, when roadways, causeways or other fill projects are constructed across FEMA-
designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain
the natural hydrology of the system as well as prevent constriction of the floodway that may result in
aggradation, degradation or significant changes in hydrology of streams or wetlands."
The proposed changes to the stream morphology by the addition of the culvert may have a dramatic impact on the
stability of the stream, both up and downstream of the proposed impact, by changing the channel's ability to transport its
bedload in its current state of equilibrium. Your letter of June 14, 2002 does not include enough information for this Office
to determine or predict whether or not the stream's ability to transport its bedload without aggrading or degrading can be
achieved with the current culvert design. This is of particular concern in waters classified as WSII ORW (water supply II,
outstanding resource).
As such, you must demonstrate that the proposed culvert will not destabilize the stream and that equilibrium will be
maintained. In any event, I would like to suggest that we schedule a meeting to discuss this matter as similar situations
are likely to arise. The aim of this meeting would be to develop specific protocols to address this situation so that we do
not have to put these (and similar) projects on hold in the future.
Until this information is received, I will place this project on hold due to incomplete information (15A NCAC 2H .0507(a))
