Thank you for your PCN and attached information, dated 6/28/2016 (received 6/30/2016), for the above referenced
project. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide
Permit 39 http://www.saw.usace.army.miI/Portals/59/docs/regulatory/regdocs/NWP2012/NWP39 3-23.pdf. Please
submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we
may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file:
1) The "Proposed Borrow Area" as shown on Figure 7 was not reviewed during the previous JD site visits to the Dan
River Steam Station. Topography in the area suggests the potential for wetlands, streams or other waters of the
US within this footprint. Has an evaluation of potential waters of the US been conducted in this area? Please
provide the information necessary for the Corps to determine if a Jurisdictional Determination (JD) verification
site visit is required. The results of the JD will determine if further avoidance and minimization or permitting of
impacts to these resources is required.
2) In section C.2a of the PCN, please change the wetland impact type to "Permanent " given the permanent
conversion of waters type proposed for this project; this is similar to the 48" pipe closure project at the Dan
River Steam Station permitted under SAW -2015-01670.
3) Your cover letter mentions "the placement of a riser pipe, filler aggregate, and pump system" required for the
proposed project. Similar to SAW -2015-01670, please provide the plan/profile views of this structure and
itemize the amount of fill material proposed in wetlands for this system, however small.
4) Are any impacts to streams or wetlands proposed for stormwater outfall SW -101, labeled on Figure 7 as a
"gabion chute?" If so, please add those proposed impacts to the PCN and provide plan/profile views of this
structure.
5) Please provide a brief description of the overall purpose of the Stormwater Diversion project. Although the plans
in Figure 7 suggest movement of runoff and ash basin water primarily to a leachate tank, portions of what is
accomplished by each pipe is not clear. For example, although some water from the Water Storage Area (WSA 1)
will be pumped via Line 2A to the leachate tank, other water from WSA 1 will apparently be pumped to an
Upland Flow Area which drains untreated via Line 1 directly into a jurisdictional stream. Please explain the
general movement of water in the proposed plan, what gets treated, and how.
6) Are any wetland or stream impacts proposed from the proposed Divider Berm, occasional flooding, Line 1
headwall, or Line 2B outfall? T' If so, please add those proposed impacts to the PCN and provide plan/profile
views of this structure.
