D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S&EC completed a wetland, stream and riparian buffer delineation for the proposed infrastructure project so that the
project engineers could design a plan to minimize impacts to the natural resources to the maximum extent practicable. .
The proposed infrastructure project, which consists of a 14" Force Main and a 12" water line, will result in ten impact
areas along New Hill Olive Chapel Road & Olive Chapel Road associated with construction clearing and the open -cut
construction method. The project will for the most part consist of a 30' wide utility easement with a 20' wide permanent
maintenance corridor that will result in a `permanent conversion" from a forested wetland to an herbaceous wetland (i. e.
permanent, no permanent loss). Exceptions to this 30' wide easement are at the far west along New Hill Olive Chapel
Road where there are no proposed impacts and the far east within the Town of Cary Beaver Creek Pump Station property
where the two utility lines separate to connect to existing utility lines.
Stream Impacts:
The project is proposing five stream crossings impact areas, including three stream crossings that will require rip -rap to
be keyed in to the stream bed for future maintenance access. The rip -rap is necessary because in these three locations
the utility lines divert away from Olive Chapel Road and go north to avoid the USA CE property, which cuts through
forested areas. The Bore & Jack/directionally drill construction methods were not utilized because per the project
engineer, based on the geotechnical investigation completed in close proximity, it is expected that rock would be
encountered at the stream crossings. Additionally, the project engineer stated that installation beneath the streams by
trenchless technologies is extremely expensive and with the requirement of future maintenance access, temporary
impacts would ultimately be required. Finally, just north of the Beaver Creek Pump Station is an overhead powerline that
added design constraints.
Wetland Impacts:
The project is proposing eight wetland impact areas which consist of the temporary construction easement and the
permanent maintenance corridor (i.e. permanent, no permanent loss). Permanent (i.e. permanent, no permanent loss)
wetland impacts have been minimized by the Town allowing a narrower permanent maintenance corridor throughout the
project but specifically on the Beaver Creek Pump Station property. Wetland impact area 6A & 6B was chosen based on
the Town of Cary comments and requests. It was understood by the project engineer that there are a lot of structures
and underground piping on the east side of the Beaver Creek Pump station, with no room to get between the eastern side
of the Pump Station and the property line. Additionally, it was understood by the project engineer that the Town of Cary
wanted the new utilities to stay as far away as possible to avoid existing infrastructure. And finally, just north of the
Beaver Creek Pump Station is an overhead powerline that added design constraints.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 12. With respect to
utility line activities (NWP 12 -Regional Conditions section 4. 0), the applicant is not proposing to directionally drill or Bore
& Jack under Beaver Creek because of the potential for bedrock, any temporary discharges into wetlands during
construction activities will be kept to minimum period of time and will be contained with appropriate erosion control
methods, the maximum width of the construction corridor to be 30' wide to accommodate both the Force Main and the
water line, utilities are not crossing the AIWW, the utilities are not aerial communication lines, the cleared wetlands within
the construction corridor will be allowed to re -vegetated with native species and the permanent maintenance corridor for
the section of the easement that includes both the Force Main and waterline will be 20' wide, however will be minimized to
10' wide within the Beaver Creek Pump Station property where the utilities split and the wetlands are expansive; use of
riprap will be minimized and only be necessary at the three (3) crossings once the easement leaves the road side.

Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that "other publically funded projects" mayor may not result in .cumulative impacts: The proposed Town of Apex -
Olive Chapel Road Force Main & Waterline project will have low potential for cumulative impacts. since no new impervious
surface is required. It is important to note that the project is located within Town of Apex,. therefore.any proposed
adjacent properties that have potential for development will have the following regulations to protect downstream
waters: 1) the Water Supply,. Watershed Protection Program Which limits development densities as well as requires
protective riparian buffers, 2) the Jordan Watershed Basin: Riparian Buffer Protection regulations, these regulations
require limited development within the riparian buffer area in addition to `'diffuse flow" requirements at a minimum,.
and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved, and f1nally 3)
the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal
Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management. requirements.
We anticipate that the DWR will advise.us if any additional information is needed.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the
table below. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation
program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility
of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must
also comply with all other state, federal or local government permits, regulations or authorizations associated with
the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this
acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an
applicant is calculated based upon the Fee Schedule and policies listed at http://portal.ncdenr.org/web/eep.
Based on the information supplied by you in your request to use the DMS, the impacts that may require
compensatory mitigation are summarized in the following table. The amount of mitigation required and assigned
to DMS for this impact is determined by permitting agencies and may exceed the impact amounts shown below.

We are providing this letter in accordance with 33 CFR §332.8(r), to confirm that .178 Riparian Wetland Mitigation
Credits (Credits) from the Cripple Creek Stream & Wetland Mitigation Bank (Bank) are currently available and may
be used, once transferred, for compensatory mitigation relative to the Town of Apex -Olive Chapel Road Force Main
& Waterline project, and as proposed by Town of Apex (Applicant).
The Applicant may ultimately purchase the Credits, if they are available, following Permit issuance. Should the
Applicant purchase the Credits at that time, we will complete and execute the Compensatory Mitigation
Responsibility Transfer Form (Transfer Form) within five (5) days of receipt of the full purchase price.
We will additionally provide copies of the completed and executed Transfer Form to the Applicant, the Bank's US
Army Corps (USACE) Project Manager and, if needed, other regulatory agencies. In addition, we will provide USACE
with an updated copy of the Bank's Ledger, reflecting the transaction. Transaction information in the updated Bank
Ledger will include relevant Permit and Applicant information as well as the number and resource type of the debited
