Mr. Vilas,
On June 23, 2016, the Division of Water Resources (Division) received your application dated June 20, 2016, requesting a
401 Water Quality Certification from the Division for the subject project. The Division has determined that your
application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
This project must develop and provide a stormwater management plan (SMP) that is protective of water quality
standards. Reference Appendix A: Stormwater Requirements (attached) for low density review criteria and
submit a plan that is in accordance with low density project stormwater requirements. The PCN application
indicates that piped conveyances may be necessary for upslope drainage and stormwater routing around
facilities. In this case, other stormwater control measures (BMPs) may be proposed to provide equal or better
treatment than that provided by strict use of vegetated conveyances.
2. Please provide an agent authorization from the State Property office for the proposed work[15A NCAC 02H
.0502(f)]
3. This office has concerns about the placement of the sludge lagoon in a draw that drains to an existing
conservation easement proposed for enhancement activities (UT Shadrick) by the NC Division of Mitigation
Services (DMS). Please explain how water quality will not be degraded downstream of the proposed sludge
lagoon. Please note an NPDES permit may be required for any discharge from a treatment facility.
4. Please provide a NEPA or SEPA final approval letter from the State Clearing House in order for this application to
be considered complete.
5. Per item 6b of the PCN on page 5, please provide a proposed timeframe for completion of the phases.
6. Please provide correspondence from Duke Energy Lake Management and DMS indicating approval of the
proposed project.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 calendar days, of
receipt of this email, the Division will be unable to approve the application and it will be returned. The return of this
project will necessitate reapplication to the Division for approval, including a complete application package and the
appropriate fee.
