Unfortunately, legal counsel for the Environmental Management Commission (EMC) did not agree that major variance requests could be delegated to Division staff without going through the rulemaking process. Therefore, your request has been placed on the September meeting agenda of the Water Quality Committee of the EMC. I reviewed the additional information that you provided and have the following items that need to be corrected. 1. The proposed rain garden is located in Zone 1 not Zone 2 as listed in the amended application. List the impact for the rain garden in Zone 1 and total the impacts as shown on the attached markup of application. 2. Mitigation is also required for the rain garden. Update the mitigation table as shown on the attached markup. 3. Request and submit a new mitigation letter to reflect the entire amount of buffer mitigation credits needed (i.e. 2,280) 4. The revised site plan is confusing because it shows the entire footprint of the home as an impact rather than only the footprint outside the footprint of the previous home. 5. The site plan (labeled as stream survey — elizabethstn-611-stream.dwg) provided in the original application most accurately depicts the information needed for the variance request. However, a couple of corrections are needed to this drawing. a. Add the driveway to show that the existing driveway will be utilized for the home. Is there no sidewalk proposed from the existing driveway to the new home? b. The voluntary planting proposed 10 feet wide along the stream channel is shown outside the lot boundary. Do you have adjacent property owner permission? If not, please correct the drawing to show replanting within the lot boundary only, provide the square footage of the area proposed for replanting and the number of trees to be planted based on a rate of 260 trees/acre. 6. At #2 under Section D. Stormwater, list the square footage of the house footprint, which will be treated by the proposed rain garden. It is important to note that, if additional impacts are proposed (i.e. sidewalk), then the buffer impact table, mitigation table and mitigation letter must be revised to reflect the additional impact. Please provide the information above as soon as possible. I must have all of the materials for the meeting finalized and submitted for posting by August 12, 2016 in order to make the September meeting. For projects in the Goose Creek Watershed, list all riparian buffer impacts as Zone 1 and use Zone 1 multiplier. 3. Provide a description of how mitigation will be achieved at your site pursuant to the mitigation requirements of the applicable river basin/watershed. Applicant shall submit a landscape and revegetation plan that uses a mix of species regardless of whether less than 20 trees are determined to be necessary on the subject parcel.
