In response to the review comments received on February 19, 2008, please find
enclosed for your review a $240.00 check for the above referenced project.
The following are responses to the review comments:
1.) Please note we are applying for written concurrence due to the fact that the .
project is within river basins with Riparian Area Protection Rules (or Buffer
Rules) from which we are not exempt. We are not requesting written approval for
a 401 Certification. It has been our past experience and our understanding that
when applying for written concurrence solely for Buffer Rules, the fee is not
applicable as stated in the PCN application form; however, we have included a
$240.00 check upon your request. If this request has been made in error, please
return the check to us.
2.) Since the project is a utility project, we do not have survey for the entire site;
therefore we are unable to provide the Riparian Buffers as overlays on the site
map since the only areas that were surveyed were the areas being affected by the
utility line installation. In order to determine the buffered areas we contacted
DWQ to perform a site determination. DWQ performed a stream determination
in the field using the Soils Maps as well as the USGS maps. The only Soils map
available was very old and did not have the current development in this area. The
USGS maps only include the streams that surround this area, not those actually
lying within our project area. This being the case, we were unable to get GIS data
to reference in to our site map.
