Aaron,
I've submitted the Division's letter requesting additional information for my supervisor's signature, but will not
be able to email it until Monday. Listed below are the items that are included in the letter. I've attached a
blank O&M for rain gardens for your use. I will have to get you guidance for the deed restriction next
week. I've also attached the help document for the application. It should be helpful in explaining how to
complete the application form and where to find resources for completing the form.
1. Provide an 8 %Z x 11 excerpt from the most recent version of the USGS topographic map indicating the
location of the site. (See 5d of the Variance Application Help Document) [15A NCAC 02B .0233(8)(b)(iii)]
2. Provide a copy of the map recorded in map book 1 at page number 155 (See 6e of the Help Document)

Provide photographs depicting the construction completed at the time you were notified that
construction of the home would require a variance from the Neuse Buffer Rule. [15A NCAC 02B
.0233(9)(i)]
4. Add the square footage of buffer impact resulting from the rain garden to the impact table at C.1. [15A
NCAC 02B .0233(8)(b)(ii)]
5. Complete the total buffer impacts section of the impact table at C.1.
Buffer mitigation is required for the proposed buffer impacts. Please submit a mitigation plan detailing
the amount of buffer impact for Zone 1 and/or Zone 2 and how the impact will be mitigated. From our
meeting, I understand that you plan to mitigate the buffer impacts through payment into a buffer
restoration fund. You will need to submit an acceptance letter from the mitigation bank that you
propose to use stating that they have the mitigation credits available for the mitigation requested. See
3.b. of the Variance Application Help Document [15A NCAC 02B .0233(9)(ii)]
Provide an estimate of the square footage of impervious area that will be directed to the proposed rain
garden. [15A NCAC 02B .0233(9)(iii)]
8. Provide a planting plan for the proposed rain garden including the number and species of plants to be
planted. Please see the following website for planting guidance http://water.monroenc.org/wp-

9. Provide a draft deed restriction that will ensure that the rain garden and drainage to them will be
maintained in perpetuity. Guidance and sample documents will be to emailed to you for your use.
10. Provide an operation and maintenance agreement for the rain gardens. Guidance and sample
documents will be to emailed to you for your use.

Aaron,
I left you a message on Monday asking you call me. Unfortunately, your application is not yet complete and will
not make the July deadline for the EMC. However, as I mentioned on Friday when you dropped it off, we are
requesting delegation of certain major variance requests from the EMC at the July meeting. Your project would
qualify for Division approval if this delegation is granted. I will prepare a letter early next week that itemizes the
additional information that will be need to process the variance request.
