HomeMy WebLinkAbout20160640 Ver 1_Buffer Determination_20160715Water Resources ENVIRONMENTAL QUALITY July 15, 2016 Mr Neil & Dianne Bowen A D Swindell Farms, LLC PO Box 279 Pantego, NC 27860 PAT MCCRORY Govemor DONALD R VAN DER VAART Secretary S JAY ZIMMERMAN Director DWQ # 16-0640 Beaufort County Subject Property Canal #14 Drainage Improvement Project, Pantego, Beaufort County, NC UT to Pantego Creek, Tar -Pamlico River Basin Dear Mr & Mrs Bowen On July 6, 2016, at your request, Mr Scott Vinson of the Division of Water Resources, Washington Regional Office, conducted an on-site determination to review an unnamed tributary (UT) to Pantego Creek, named Canal #14, located on the subject property to determine if the feature would be considered a stream using the NC Division of Water Resources Stream Classification Form The feature is labeled as "16-0640" on the attached map(s) initialed by Mr Vinson on July 15, 2016 The subject property is located north off Swindell Road, northeast of Pantego, Beaufort County, North Carolina The Division of Water Resources (DWR) has determined that a portion of feature labeled as "16-0640" on the attached map, and highlighted in blue, is considered a stream. The stream call labeled as "16- 0640" starts at approximately 35.6322 N, 76.6736 W, just east of the culvert crossing with Morning Star Road and continues downstream to 35.5981 N, 76.6736 W before crossing under Swindell Road. Please contact Mr. Gary Beecher, (910) 251-4629, with the US Army Corps of Engineers to initiate permitting discussions on cleaning and maintaining this drainage canal. The owner (or future owners) should notify the DWR (and other relevant agencies) of this decision in any future correspondences concerning this property This on-site determination shall expire five (5) years from the date of this letter Landowners or affected parties that dispute a determination made by the DWR or Delegated Local Authority that a surface water exists may request a determination by the Director A request for a determination by the Director shall be referred to the Director in writing c/o Karen Higgins, DWR 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1650.
