As I have indicated, I expect that the draft will be issued by FERC within the next 2 weeks, and I hope that your department can then complete the consideration of the application. It is our understanding that FERC staff is nearing completion of the draft environmental assessment, and expects that the draft will be published prior to the end of July, 2016. It is also our understanding that as a draft, parties will have an additional 45 days to comment, and the FERC staff will consider the comments before the final environmental assessment is issued. I will forward a copy of the draft EA to your office when we receive it, and we hope that your review of the 401 application can continue based on that document. As the agent for the applicant, I request that the department consider this letter as a re-application for the 401 Certification for this project, utilize the existing filed materials, and extend the period for consideration of the application.
