West Street, Suite 103 Raleigh, North Carolina 27603 Reference: Deficiency of License Application Dear Mr. Givens: On April 10, 2014, we provided comments on your draft license application. We advised you that to conform to the Commission's regulations, you must revise the exhibit F drawings to include dimensions of the project and revise the exhibit G maps to show and label project features and enclose them within a continuous project boundary. On August 28, 2014, you filed your final license application which did not include any exhibit F drawings and included exhibit G maps without project features enclosed. You indicated that it would be burdensome to revise the exhibit F drawings and exhibit G maps, and on those grounds, requested a waiver of any requirement for more detailed exhibit F drawings and exhibit G maps. These exhibits are standard requirements for all licensees and are necessary for the Commission staff's review of your application and administration of any future license you may receive. Therefore, your request for a waiver of regulatory requirements is denied. In addition, Exhibit A of your license application does not conform to the Commission's regulations. A detailed list of deficiencies is enclosed as Schedule A. Under 18 C.F.R. section 4.32(e)(1) of the Commission's regulations, you have 90 days from the date of this letter to correct the deficiencies in your license application. If the correction of any deficiency or any additional inforination provided causes other parts of the license application to be inaccurate, that part must also be revised and refiled by the due date. Within 5 days of receipt, provide a copy of this letter to all agencies you will consult in response to this deficiency. Then, when you file the requested information Project No. 13102-003 2 with the Commission, you must provide a complete copy of the information to each agency consulted under 18 C.F.R. section 4.38 of the Commission's regulations. Exhibit A (1) Section 4.61(c)(1)(vii) of the Commission's regulations requires that the Exhibit A include, in relevant part: the estimated minimum and maximum hydraulic capacity of the plant (flow through the plant) in cubic feet per second. You did not provide the minimum hydraulic capacity of the plant. Please provide the minimum hydraulic capacity of the plant. (2) Section 4.61(c)(8) of the Commission's regulations requires that the Exhibit A include a detailed single line electrical diagram. Please provide the diagram. Exhihit F (3) Section 4.41(g) of the Commission's regulations requires that the license application contain an Exhibit F, consisting of general design drawings of the principal project works described in Exhibit A and supporting information used as the basis of design. Your license application did not include any exhibit F drawings. The exhibit F drawings must show all major project structures in sufficient detail to provide a full understanding of the project (see 18 CRR section 4.41 (g)(1)). Please provide exhibit F drawings, and include the dimensions of the project on the drawings. Exhibit G (4) Section 4.41 (h)(2) of the Commission's regulations requires that the Exhibit G map show a project boundary enclosing all project works and other features described in Exhibit A that are to be licensed. Your exhibit G map does not show a project boundary. If accurate survey information is not available at the time the application is filed, the you must so state, and a tentative boundary may be substituted. The boundary must enclose only those lands necessary for operation and maintenance of the project and for other project purposes, such as recreation, shoreline control, and protection of environmental resources. Please provide an exhibit G map with a project boundary that encloses all project works and other features that are to be licensed, including your canoe portage.
