Hi Pete,
The NWP 18 comments (recommended denial) are on Shannon's desk, they are to
be sent to DWQ, USACE, and Mr. Shackelford's environmental consultants.
I'll forward this email to David, Shannon, Scott Jones (USACE), and Ian
McMillan (DWQ). I don't know if they have formally withdrawn the NWP
application or not. I spent over 45 minutes in a conference call with his
engineer, partner, and him on Tuesday. I told them it didn't matter to us
whether the pond was for agricultural irrigation, a residential development,
or a commercial development, our recommendation would be that the stream not
be dammed and the buffer restored. I also asked them if they wanted to meet
with me, representatives from DWQ, and USACE, to contact the one-stop
coordinator at the Washington DENR office and arrange for a pre-app meeting
for the IP.
He and I played phone tag from 4-5 yesterday so I finally told him to leave
me a detailed message of what he wanted.
Shannon, When the comments are signed, could you please send a copy to Mr.
Shackelford as well?
The NWP application for an agricultural pond was signed 1/19/07 by Mr.
Shackelford and stated that they were in the early planning stages of a
subdivision and that they did not know if or when it would be built.
However, on Tuesday they were quoting $16M in pre-sale reservations that
hinged on this lake that was to be the centerpiece of the golf course.
David, Bob, and I have discussed the option of building the lake off-stream,
but according to the master plan on their website, they already have several
ponds and another lake planned. I would have recommended this if we have
the pre-app meeting.
The application should have been for the subdivision, not just the dam and
lake.

I just had an interesting phone call from Mr. Buzz Shackleford (sp?) about
his Corps permit for his dam in Greene County.

Bob & Bennett- isn't this the guy you were talking about yesterday when we
were eating lunch?
He called the Raleigh office and Faye told him I was the regional supervisor
so I guess he thought I was the man to talk to.
Steve- apparently he wasn't satisfied with what he heard from you!
He was insistent that I send him WRC's written comments on his project from
when it was in the form of a Nationwide Permit application and I advised him
that if it ever had been a NWP application, we would likely not even known
about it, much less commented on it.
During our conversation, he tried to impress on me that he and his project
have been greatly misunderstood; that it started out as an agricultural pond
and then he had some sort of epiphany that transformed his pond into
something surrounded by a golf course.
He asked if we would be commenting to the Corps now that he has to get and
individual permit and I advised him that we would. He asked if he could get
a copy of our comments and I told him that any of our comments were public
documents and that he was welcome to them. He asked that when we make our
comments to send him a copy at P.O. Box 207, Hookerton, NC 28538.
