Dear Mr. Robichaud:
On February 11, 2008, the Division of Water Quality (DWQ) received your request to have DWQ review
and approve the final mitigation plan for the above referenced project. The revised 401 Water Quality
Certification (WQC) for this project was issued on February 23, 2007. The 401 WQC indicated that there
would be 570 linear feet of onsite stream restoration performed as a component of the mitigation plan.
However, on October 17, 2007, we received information from you indicting that the onsite restoration
would produce 440 linear feet of stream credit with the balance to be purchased from the NC EEP. Again
on February 11, 2008, we received restoration plans which now show the onsite stream restoration again
producing 570 linear feet of stream credit. These plans appear very similar to the plans received on
October 17, 2007. Please explain this discrepancy.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMi n at 919-733-
