On behalf of YMCA of the Triangle, Inc., we are requesting authorization from the USACE to utilize
NWP 39 for 115 If of permanent stream impacts and 0.065 acres of temporary wetland impacts for
construction of the proposed YMCA facility. We are also requesting a 401 WQC from NCDWR for
the above referenced impacts, as well as a Buffer Authorization for 6,561 sf of permanent impacts
to Neuse River Riparian Buffers.
The project is ±13.92 acres in size and is located east of the intersection of Aversboro Road and Old
Scarborough Road in Garner, Wake County (Latitude: 35.681901°N; Longitude: -78.622342°W).
The project is located in the Neuse River basin (HUC: 03020201) and onsite waters drain to Swift
Creek (Lake Benson). The Water Quality Classification for Swift Creek (Lake Benson) is WS-
III;NSW,CA and the Stream Index Number is: 27-43-(5.5).
Proposed Project
The purpose of the proposed project is to construct a YMCA facility to meet the recreational needs
of Garner, as such a facility does not currently exist within this area. The proposed project consists
of the construction of a YMCA facility and associated infrastructure including parking, utilities,
stormwater management and greenway trail.
In 1974, The Bell and Holding families donated the subject property to the YMCA. In 1998, the
YMCA established a program center in Garner that today serves more than 1,100 children at 10
sites. The YMCA of the Triangle relies on local schools and community centers for space to offer
after-school, day camp, sports, teen leadership programs, and year-round tracking -out programs.
This permanent facility allows the YMCA to expand and enhance programming for fitness, wellness,
family programming, and health initiatives for all ages within the Garner community.
As a part of the YMCA of the Triangle, the Poole Family YMCA will have the features of a full service
branch within the Association including gymnasium, fitness studios, locker rooms, children's center,
wellness floor, indoor track, and an outdoor aquatics center. The community requested the outdoor
aquatics center, indoor track and group exercise studios as necessary amenities, as these are
currently deficient in this community. This facility will likewise offer diverse programming meeting
the needs of the community: swimming lessons, group fitness classes, family activities, wellness
education and training, quality childcare, teen programs and youth sports. While the site is narrow,

it is able to accommodate a compact building footprint, the outdoor swimming pool, a small
recreation area, and parking.
The building orientation along with adjacent parking and other features have been carefully located
to avoid impacts on the natural features of the site where feasible. The outdoor aquatics center has
been located close to the building and parking is provided around the building and pools for the
convenience of those using the facility. In addition to considering site impacts, YMCA of the
Triangle parking requirements are based on actual conditions at the 15 other facilities in six
Triangle region counties. While the number of parking spaces exceeds the minimum requirement
of the Town of Garner, parking demand is considered at the typical AM/PM peak times and the need
to provide adequate on-site parking to keep vehicles off local streets. Also considered are the
convenience of proximate parking to the primary entrances of the facility and the pool coupled with
accessibility requirements.
Please refer to the attached letter from YMCA of the Triangle, Inc. for a more in depth discussion of
the proposed Poole Family YMCA project.
Project History
Wetlands within the YMCA property (PIN: 1710138336) were delineated by WithersRavenel in
July 2015 and a Preliminary JD Request was submitted to David Shaeffer with the Corps of
Engineers on 07/28/15 via email. In an email dated 09/23/15, David Shaeffer preliminarily
approved the delineation (AID: SAW -2015-01777), but the approved Jurisdictional Determination
has not been received as of the date of this application. A copy of Mr. Shaeffer's email has been
provided as an Appendix.
Since the original submittal of the JD Request, the project design has changed to include an offsite
greenway trail connector to the greenway within White Deer Park to the west. As a result, WR has
delineated the wetlands and streams within the greenway corridor. A revised Preliminary JD
Request has been provided as an Appendix which includes both the YMCA property and offsite
greenway corridor. We are requesting issuance of the Preliminary JD in conjunction with issuance
of the NWP 39.
NCDWR issued a Buffer Determination for the YMCA property (PIN: 1710138336) on 08/03/15
(NBRRO #15-323), which has been provided as an Appendix. The only depicted stream within the
offsite greenway alignment is the downstream portion of Feature A, which was determined to be
subject to buffers under the Buffer Determination for the YMCA property. Therefore, a Buffer
Determination for the offsite greenway alignment is not necessary.
Proposed Impacts
The proposed impacts consist of 115 If of permanent intermittent stream impacts, 0.065 acres of
temporary wetland impacts and 6,561 sf of permanent riparian buffer impacts.
Wetland & Stream Impacts
Impact 3 will result in 115 If of permanent stream impacts for construction of outdoor aquatics
facility and parking lot. Impact 3 will impact the uppermost reach of Stream 3, which is a small

intermittent stream. Retaining walls have been utilized to stabilize fill for the aquatics center and
parking lot in order to minimize stream impacts.
Impact 7 will result in 0.023 acres of temporary wetland impacts for connection of the onsite sewer
system to an existing manhole.
The 0.023 acres of wetland impacts at Impact 7 are considered "permanent conversion" impacts by
the Corps of Engineers, as the entire 20 If sewer easement within the wetlands will be
maintained/mowed in perpetuity, thereby permanently converting forested wetlands to
herbaceous wetlands.
Impact 8 will result in 0.042 acres of temporary wetland impacts during construction of the
elevated pedestrian bridge over the wetlands for the greenway trail. The temporary impacts will
consist of clearing of the alignment of the elevated pedestrian bridge, as well as disturbance from
equipment during construction of the bridge. The pedestrian bridge will be constructed on pilings,
and no permanent wetland impacts will occur.
Neuse River Buffer Impacts
Impact 1 (Z1: N/A; Z2: 1,703 sf) & Impact 6 (Z1: 1,273 sf; Z2: 1,009 sf) will result in permanent
riparian buffer impacts for construction of the greenway trail which will connect to the existing
greenway trail within White Deer Park to the west.
Impact 2 will result in 598 sf of permanent Zone 1 impacts and 293 sf of permanent Zone 2 impacts
for construction of the outfalls for SCM #3 (Wet Pond).
Impact 4 will result in 487 sf of permanent Zone 1 impacts and 668 sf of permanent Zone 2 impacts
for construction of the outfall for SCM #1 (Bio- Retention).
Impact 5 will result in 530 sf of permanent Zone 2 impacts for connection of the onsite sewer to an
existing manhole. The entire 20 If sewer easement will be mowed/maintained in perpetuity, and
therefore the entire 20 If easement has been assessed as a permanent buffer impact.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
The linear configuration of the project site, along with the topography, wetlands, streams and
riparian buffers resulted in constraints on the site design. As a result of the buffered stream and
wetlands along the southern property boundary, all development had to be concentrated in the
northern portion of the property.
The proposed site design has gone through numerous revisions in an effort to minimize impacts to
onsite wetlands, streams and riparian buffers. The original site plan from August 2015 and
currently proposed site plan have been provided as Appendices to document the avoidance and
minimization of impacts through site design revisions. The August 2015 site design would have
resulted in impacts to the majority of Stream 3, as well as significant wetland impacts from
construction of the outdoor aquatics center, a BMP and the parking lot, and impacts would have

exceeded the impact thresholds for a NWP, resulting in a need for an Individual Permit. The
revisions to the site plan to minimize impacts include:
• Revisions to the outdoor aquatics center through swapping the locations of the lap pool and
kid pool, as well as the reduction in size of the kid pool.
• Shifting of the outdoor aquatics center east, closer to the main YMCA Building, which
resulted in a loss of the outdoor exercise area between the main YMCA Building and
outdoor aquatics center.
• Elimination of the Drop Off/Entry Plaza to allow the outdoor aquatics center to be shifted
further east.
Designing retaining walls along the outdoor aquatics center and parking lot to stabilize fill
rather than traditional backslopes which would have resulted in greater wetland and stream
impacts.
Relocation of the greenway trail and chapel from along the southern stream/buffers to
allow for redesign of the BMP (SCM 2) to eliminate wetland and stream impacts for the
BMP.
The site plan has been revised to greatly reduce proposed impacts, minimizing impacts to below
NWP impact thresholds, resulting in the project being eligible for authorization under a NWP 39.
Proposed permanent stream impacts will occur to the northern unbuffered intermittent stream
(Stream 3) for construction of the outdoor aquatics center and parking lot. The outdoor aquatics
center is critical to the success of the proposed YMCA center, as this is typically the most
immediately utilized component of any YMCA center and will fill a deficiency in the community, as
there are no such facilities available to the public in this area. Additionally, the outdoor aquatics
center typically generates most of the income for the facility over the first two years after opening,
which is critical to the financial feasibility of the project.
The parking lot has been designed to provide parking based on the parking demand at typical
AM/PM peak times for the other 15 YMCA facilities in the six Triangle region counties. Providing
adequate on-site parking is critical to preventing guests from parking their vehicles on adjacent
local streets, which would create both traffic and pedestrian safety hazards. The parking lot layout
has gone through several design alternatives to identify the best parking layout for the parking
spaces needed for this facility. The wooded area in the northwest portion of the site, north of the
multi -use play field, is not a feasible option for providing additional parking. Specifically, the
distance from the YMCA facility is problematic for accessibility. But more importantly, this area
receives significant runoff from the adjacent subdivision. If this area was designed for parking, the
impervious area to be treated, along with having to capture the offsite runoff in the stormwater
management system would have resulted in a drastic increase in the size of the BMP (SCM 3). Even
with the elimination of the multiuse play field, the increased size of the BMP (SCM 3) would take up
so much area that the actual number of parking spaces provided would not have resulted in any
significant changes to the main parking area that could have reduced impacts.
Wetland impacts have been minimized to only temporary impacts needed for connection of the
onsite sewer system to an existing sewer manhole and temporary impacts necessary for
construction of the elevated pedestrian bridge for the greenway. Temporarily impacted wetlands
will be restored to natural grade and seeded with a wetland seed mix to provide stabilization until
natural recruitment permanently stabilizes these areas.

Riparian buffer impacts have been minimized to only those necessary for construction of the
greenway trail connector to White Deer Park, connection of the onsite sewer to an existing sewer
line and outfalls for the BMPs, which are "Allowable".
The currently proposed impacts represent the maximum avoidance and minimization of impacts to
wetlands, streams and buffers while maintaining a feasible project.
Mitigation
Stream Mitigation
The proposed permanent stream impacts will occur to an intermittent stream and are less than 150
If, and therefore stream mitigation is not proposed.
Wetland Mitigation
All proposed wetland impacts are temporary, and "permanent conversion" impacts are less than
0.10 acres, and therefore wetland mitigation is not proposed.
Buffer Mitigation
All proposed riparian buffer impacts are classified as "Allowable" in the Neuse River Riparian Buffer
Rules Table of Uses, and therefore buffer mitigation is not required.
Stormwater Management Plan
The proposed Stormwater Management system consists of a combination of Bio -retention (SCM
#1), a constructed wetland (SCM #2) and a wet detention pond (SCM #3). The bio -retention and
constructed wetland provide sufficient TN and TSS removal and discharge at non-erosive velocities
and diffuse flow is not required. The wet detention pond will provide sufficient TN and TSS removal
to eliminate the need for diffuse flow, and will discharge directly into the stream through the bypass
outfall. The Stormwater Management Plan will be reviewed and approved by the Town of Garner.
The current request is for 115 If of permanent stream impacts, 0.065 acres of temporary wetland
impacts and 6,561 sf of permanent impacts to Neuse River Riparian Buffers (see the attached
maps and PCN for details).

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands
and "waters" could be minimized.
The linear configuration of the project site, along with the topography, wetlands, streams and riparian buffers resulted in
constraints on the site design. As a result of the buffered stream and wetlands along the southern property boundary, all
development had to be concentrated in the northern portion of the property.
The proposed site design has gone through numerous revisions in an effort to minimize impacts to onsite wetlands, streams
and riparian buffers. The original site plan from August 2015 and currently proposed site plan have been provided as
Appendices to document the avoidance and minimization of impacts through site design revisions. The August 2015 site
design would have resulted in impacts to the majority of Stream 3, as well as significant wetland impacts from construction of
the outdoor aquatics center, a BMP and the parking lot, and impacts would have exceeded the impact thresholds for a NWP,
resulting in a need for an Individual Permit. The revisions to the site plan to minimize impacts include:
• Revisions to the outdoor aquatics center through swapping the locations of the lap pool and kid pool, as well as the
reduction in size of the kid pool.
• Shifting of the outdoor aquatics center east, closer to the main YMCA Building, which resulted in a loss of the outdoor
exercise area between the main YMCA Building and outdoor aquatics center.
• Elimination of the Drop Off/Entry Plaza to allow the outdoor aquatics center to be shifted further east.
• Designing retaining walls along the outdoor aquatics center and parking lot to stabilize fill rather than traditional
backslopes which would have resulted in greater wetland and stream impacts.
• Relocation of the greenway trail and chapel from along the southern stream/buffers to allow for redesign of the BMP
(SCM 2) to eliminate wetland and stream impacts for the BMP.
The site plan has been revised to greatly reduce proposed impacts, minimizing impacts to below NWP impact thresholds,
resulting in the project being eligible for authorization under a NWP 39.
Proposed permanent stream impacts will occur to the northern unbuffered intermittent stream (Stream 3) for construction of
the outdoor aquatics center and parking lot. The outdoor aquatics center is critical to the success of the proposed YMCA
center, as this is typically the most immediately utilized component of any YMCA center and will fill a deficiency in the
community, as there are no such facilities available to the public in this area. Additionally, the outdoor aquatics center typically
generates most of the income for the facility over the first two years after opening, which is critical to the financial feasibility of
the project.
The parking lot has been designed to provide parking based on the parking demand at typical AM/PM peak times for the other
15 YMCA facilities in the six Triangle region counties. Providing adequate on-site parking is critical to preventing guests from
parking their vehicles on adjacent local streets, which would create both traffic and pedestrian safety hazards. The parking lot
layout has gone through several design alternatives to identify the best parking layout for the parking spaces needed for this
facility. The wooded area in the northwest portion of the site, north of the multi -use play field, is not a feasible option for
providing additional parking. Specifically, the distance from the YMCA facility is problematic for accessibility. But more
importantly, this area receives significant runoff from the adjacent subdivision. If this area was designed for parking, the
impervious area to be treated, along with having to capture the offsite runoff in the stormwater management system would
have resulted in a drastic increase in the size of the BMP (SCM 3). Even with the elimination of the multiuse play field, the
increased size of the BMP (SCM 3) would take up so much area that the actual number of parking spaces provided would not
have resulted in any significant changes to the main parking area that could have reduced impacts.
Wetland impacts have been minimized to only temporary impacts needed for connection of the onsite sewer system to an
existing sewer manhole and temporary impacts necessary for construction of the elevated pedestrian bridge for the greenway.
Temporarily impacted wetlands will be restored to natural grade and seeded with a wetland seed mix to provide stabilization
until natural recruitment permanently stabilizes these areas.
Riparian buffer impacts have been minimized to only those necessary for construction of the greenway trail connector to White
Deer Park, connection of the onsite sewer to an existing sewer line and outfalls for the BMPs, which are "Allowable".
The currently proposed impacts represent the maximum avoidance and minimization of impacts to wetlands, streams and
buffers while maintaining a feasible project.

property or within 1.0 miles of the project, see attached NCNHP project review letter. Site reviews did not identify any
potential habitat for any federally protected species known to occur in Wake County, except for the Northern Long Eared
Bat.
Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used
for roosting during the day. Since the entire project area consists of mature forest over 3" DBH, there is potential northern
long eared bat habitat present. The USFWS Final 4(d) rule for the Northern Long -Eared bat specifies that tree removal
within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known
hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft -
radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25
miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Therefore, WR
concludes that the project "may affect, but is not likely to adversely affect" the northern long-eared bat.

Environmental Impact Justifications - Summary
The YMCA of the Triangle Area will build a new full-service facility at 21 10 Aversboro Road in Garner
scheduled to open in late 2017 or early 2018. Our Civil Engineer/Land Planning firm, WithersRavenel
Inc., has created various site plan options that were developed during the early design phases of the
project. While each of these design iterations lessened the environmental impact, the site plan
submittal to the Town of Garner includes some impacts on the existing jurisdictional features and
stream buffers identified on the site. Some of the early design impacts were minimized by relocation
of the greenway trail extension to White Deer Park. This and two outfalls from the BMP's are
allowable impacts. We understand the current design impacts approximately 115 LF of un -buffered
stream.
Several points are offered below relative to the property and the required improvements to sustain a
facility that supports the community through programs meeting our principles of youth development,
healthy living, and social responsibility. These can be considered as justification that the project
team has vetted all practical alternatives to limit impacts.
In 1974, The Bell and Holding families donated to the YMCA nearly 14 acres of land located on
Aversboro Road in Garner. In 1998, the YMCA established a program center in Garner that today
serves more than 1,100 children at 10 sites. The YMCA of the Triangle relies on local schools and
community centers for space to offer after-school, day camp, sports, teen leadership programs, and
year-round tracking -out programs. This permanent facility allows the YMCA to expand and enhance
programming for fitness, wellness, family programming, and health initiatives for all ages within the
Garner community.
As a part of the YMCA of the Triangle, the Poole Family YMCA will have the features of a full service
branch within the Association including gymnasium, fitness studios, locker rooms, children's center,
wellness floor, indoor track, and an outdoor aquatics center. The community requested the outdoor
aquatics center, indoor track and group exercise studios as necessary amenities, as these are
currently deficient in this community. This facility will likewise offer diverse programming meeting
the needs of the community: swimming lessons, group fitness classes, family activities, wellness
education and training, quality childcare, teen programs and youth sports. While the site is narrow,
it is able to accommodate a compact building footprint, the outdoor swimming pool, a small
recreation area, and parking.

Environmental Impact Justifications - Summary
The building orientation along with adjacent parking and other features have been carefully located
to avoid impacts on the natural features of the site where feasible. The outdoor aquatics center has
been located close to the building and parking is provided around the building and pools for the
convenience of those using the facility. In addition to considering site impacts, YMCA of the Triangle
parking requirements are based on actual conditions at our 15 other facilities in six Triangle region
counties. While the number of parking spaces exceeds the minimum requirement of the Town of
Garner, we consider parking demand at the typical AM/PM peak times and the need to provide
adequate on-site parking to keep vehicles off local streets. We also consider the convenience of
proximate parking to the primary entrances of the facility and the pool coupled with accessibility
requirements.
The site master plan includes a future facility addition in an area designated as "Phase 1 —
Amphitheater". This will essentially be a grassy area adjacent to the building that is graded for
appropriate drainage that can be programmed for after-school and day camp activities — more of a
gathering space for organized play than a structured 'amphitheater' with stage, seating, and audio
capabilities.
We have and will continue to work closely with community representatives from the neighborhoods
adjoining our property particularly related to programming of activities on the property. This will
include the planning for the outdoor pool and green spaces. The master plan also limits development
of permanent constructed facilities in the upper northwest corner of the site. This area is directly
adjacent to several properties that have been established since the early 1980's. A small open field
will be created at the end of the parking lot, while leaving most of the natural forest in place.
Activities will support our summer camp and after-school tracking out providing for common play
areas mostly within the current natural environment.
We know from community surveys taken prior to commencing design that the YMCA's local
programming in Garner is appreciated by community leaders and those in the community who are
aware of its impact. Providing a facility that houses these programs for children, youth, and families
in addition to the current off-site locations, will enhance and grow mutually beneficial activities for
Garner families.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre -construction notification" (PCN), or requests verification for a non -reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "maybe" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:
