The Division of Water Resources (DWR) received a Bank Parcel Development Package (BPDP)
for the above -referenced site on April 14, 2016 for review and approval under the terms and
conditions of the EBX-EM, LLC Cape Fear Riparian Buffer and Nutrient Mitigation Banking
Instrument (UBI). The UBI was made and entered into by EBX-EM, LLC (EBX), acting as the
Bank Sponsor, and the DWR on October 9, 2009 and modified on February 17, 2014. DWR
received a revised final BPDP incorporating recommendations from DWR on June 23, 2016.
On June 23, 2016, the subject BPDP was placed on public notice. DWR received no comments
regarding the subject BPDP. This BPDP is now approved.
According to the credit release schedule outlined in your UBI, the following items are required
prior to receiving your first credit release of twenty percent:
Conservation easement approved by DWR
Financial Assurance documents
