Sullins, Director Division of Water Quality February 27, 2008 DWQ Project # 08-0194 Brunswick County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Cert. # 7007 0220 0000 8225 0649 Red Apple Group, LLC 712 Village Road, SW Shallotte, NC 28470 Subject Property: B-Var Road Lot/Red Apple Group,LLC REQUEST FOR MORE INFORMATION To Whom It May Concern: On January 24, 2008, the Division of Water Quality (DWQ) received your application dated October 2, 2007, to impact 0.735 acres of non-vegetated wetlands (open water), 0.017 acres of 404 wetlands, and 0.014 acres of coastal wetlands to replace a rail system with a boat ramp, construct a docking facility, dredge the basin, install a stormwater treatment system, and a driveway with a turn-around. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or waters on the subject property. Therefore unless we receive five copies of the additional information requested below at the DWQ central office, we will have to recommend moving towards denial of your application as required by 15A NCAC 214.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: The location of the Normal High Water line flagged by Debra Wilson of the Division of Coastal Management (DCM) in July of 2007 differs from the one illustrated on the State Stormwater permit SW8061034 issued from the DWQ on April 18, 2007. Submit a revision to permit SW8061034 to the DWQ to relocate the level spreader outside of the 30-foot buffer to the Normal High Water line. 2. The application states that mitigation for the 590 square feet of Coastal Wetland impacts will consist of 600 square feet of replanting and restoration in section D of drawings E4 and E9. In addition, 255 square feet will be replanted to the original state in section B. However, these sections are included in the area to be dredged per the application. Submit a more thorough description of the mitigation plan for the site. The application states that the proposed docking facility will contain 5 boat slips. However, the design as submitted will potentially accommodate up to 10 boat slips. This discrepancy could potentially lead to further shellfish closures per 15A NCAC 18A .0911 as mentioned in the February 20, 2008 memorandum by Jeremy Humphrey of the North Carolina Shellfish Sanitation and Recreational Water Quality Section. Explain the facility design as submitted. Please respond within three weeks of the date of this letter by sending this information to me in writing and five copies to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Boulevard, Raleigh, NC 27604- 2260. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
