Proposed impacts include 0.3 acre of permanent wetland impact and 1.3 acres of temporary impacts to a pond. These impacts will result from site grading and construction activities associated with a residential retirement community. Joint Section 404 authorization and 401 certification is requested from the U.S. Army Corps of Engineers, Ashville Regulatory Field Office (COED and the North Carolina Division of Water Quality (DWQ). Literature Review As shown on Figure 2, the subject property is at an approximate elevation of 710 to 780 feet (National Geodetic Vertical Datum) according to the USGS 7.5~ Series Matthews, North Carolina Quadrangle (USGS, 1988). Four structures are shown on the topographic map as being located on the subject property. Two forested areas are mapped on the site, one near the center of the southern property boundary and one in the northwest corner of the site. Two ponds are mapped on the site, one in the southeast corner and one near the center of the northern property boundary. An intermittent stream is shown flowing north from the north-central pond. High- voltage electric transmission lines are shown crossing the eastern half of the site. A hydric soil is a soil that is saturated, flooded, or ponded long enough during the growing season to develop anaerobic conditions that favor the growth and regeneration of hydrophytic vegetation (USDA-SCS, 1985). According to the NRCS no hydric soils are located on the subject property. The Helena sandy loam (HeB) was listed as anon-hydric soil with hydric components located on the subject property (USDA-NRCS, 1 X91 & USDA-NRCS, 691). Hydric components were noted to occur in this soil in depressions and on flood plains. The Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) was reviewed for the site (FEMA, 2004). As shown on Figure 4, the subject property lies in Zone X (unshaded) which are areas determined to be outside the 500-year flood plain. The U.S. Fish and Wildlife Service's (FWS) National Wetland Inventory Map (NWI) for the Matthews, North Carolina Quadrangle was reviewed for the site (FWS, 2007). As shown on Figure 5, two wetlands were mapped on the subject property. Wetland Delineation A wetland delineation was conducted on the site by the John R. McAdams Company (McAdams) in the fall of 2006. At that time the site was referred to as the Fincher Tracts. The delineation was submitted to the COE on October 24, 2006. A follow up package containing copies of the survey plat was sent to the COE on January 24, 2007. As of the submittal of this permit request, verification from the COE had not been received. Copies of these submittals are included for reference. In September 2007 EMHB~T personnel, at the request of the Applicant, conducted a site visit to confirm the delineation. The results of the delineation concluded that three wetlands, two ponds, and one intermittent stream channel were located on the site. The delineation submitted by McAdams did not specifically label each identified feature. However, for the purposes of this permit request, EMHB~T has labeled these features on the attached "Wetland~Pond Impact Map". The features are labeled as Wetlands A, B, and C, Pond 1, and Stream 1. Wetland A originates downstream of Wetland B and at the headwaters of Stream 1. Wetland B originates downstream stream of the ponds spillway. Wetland C is located upstream of Pond 1. A second pond, located on the eastern side of the property, was identified as an isolated pond in high ground. This pond is not shown on the impact map. In September 2007 a site visit was conducted with Mecklenburg County personnel to determine if the Stream 1 was subject to the SWIM buffers. The SWIM buffer was determined to begin below Wetland A and extends for approximately 300 linear feet along the top-of-bank of Stream 1. ~I 1 1 t c Mr. Chapin and Ms. Karoli Re: Erickson Retirement Communities Campus Project Description February 21, 2008 Page 3 of 4 As seen on the attached "Wetland~Pond Impact Map", the project will include the development of a multi-unit residential retirement community. The development will consist of several buildings, walkways, common areas with green space, access roads and driveways. The development will implement a substantial amount of green space, gardens, and innovative post-construction water quality best management practices (BMP's) such as rain gardens. Of the total 81.5 acre project footprint, approximately 65.5 acres will be developed and 16 acres will remain as undisturbed open space. Impacts have been avoided to the maximum extent practicable. However, permanent impacts to the three wetlands and temporary impacts to Pond 1 are unavoidable in order to maximize developable space. Approximately 0.08 acre of Wetland A will be impacted by site grading and driveway construction. All of Wetland B, which is approximately 0.2 acre, will be impacted as a result of parking lot and driveway grading and construction. All of Wetland C, which is approximately 0.03 acres, will be impacted as a result of site grading and the re-shaping of Pond I. Pond 1, which is 1.3 acres in size, will be temporarily impacted in order to clean out excessive sediment buildup and reshape the pond. The pond will then be utilized as a community amenity and potentially as post treatment stormwater storage. No impacts to Stream 1 and its associated SWIM buffer are proposed. Photographs have been included showing the current view of the surface water resources proposed for impact. Mitigative Measures Of the total 0.44 acres of wetland identified on the site, approximately 0.3 acre or 70 percent of the features will be impacted. At this time the Applicant is not proposing specific mitigation for the relatively small amount of impacts on the site. The Applicant believes that the innovative water quality BMP's, green space, and on-site pond improvements will serve as adequate ~' mitigation for the proposed impacts. The Applicant will also enhance the buffer along Stream 1, which is currently fallow field accessible to livestock. If wetland specific mitigation is required, the Applicant proposes payment into the Wetland Restoration Program administered by the Ecosystem Enhancement Program. A mitigation plan will follow within 30 days of this permit request. ~~ Appropriate, site specific Best Management Practices have been included in construction plans to decrease erosion and sedimentation during and after construction on the project site, including the placement of sediment fence inside impact areas. All sediment controls that are utilized will be kept in place during construction activities and until the site has been stabilized. All areas disturbed during construction will be seeded to encourage the establishment of a vegetative cover and decrease erosion potential. A complete electronic copy of the stormwater management plan has been included on a CD. In addition, a stormwater concept plan has been attached showing site BMP's. It maybe useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impacts have been avoided to the maximum extent practicable. However, permanent impacts to the three wetlands and temporary impacts to Pond 1 are unavoidable in order to maximize developable mace VIII. Mitigation 1 DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Updated l1/1/2005 Page 5 of 8 1 1 1 f 1 i 1 t 1 1 1 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. At this time the Applicant is not proposing specific mitigation for the relatively small amount of impacts on the site.
