On behalf of our client, 221 South Rogers, LLC, Palustrine Group is submitting the enclosed joint
Section 404/401 Pre -Construction Notification Application for the above referenced project for your
review pursuant to Nationwide Permits 13 and General 401 Water Quality Certification number 3890.
This application is to conduct a stream stabilization as required by the City of Raleigh as a condition
for the building permit for the same property. The Certificate of Occupation is conditioned on
approval and implementation of the stream stabilization at the breach in the dam of the preexisting
Carolina Lake. The proposed stabilization is to construct a new channel to bypass the tight meander
bend which is contributing to the instability of the existing channel. The new channel provides a
more stable plan form than the existing channel as seen in the photo pages. The stream flows into
Crabtree Creek just upstream of the confluence with the Neuse River. It is located at approximately
35.769708°N, -78.551333°W. The following information is included as part of this application

The project is located at 221 South Rogers Lane in the City of Raleigh, Wake County, North
Carolina. Existing land use in the vicinity of the project commercial development.
The 404/401 (NWP 13) application presents site conditions evaluated by Palustrine Group staff
(Norton Webster) on May 6, 2016.
The proposed project seeks to stabilize the existing dam breach by constructing a new channel that
will provide a more stable bed form than the existing conditions. The property has been assessed for
the potential of developing a stream mitigation site. The Corps (Mr. Todd Tugwell) and NCDWR
(James Graham) reviewed the site. Plans are being developed to move forward with a more
expansive mitigation plan but the City of Raleigh requires stabilization of the dam breach as part of
the building permit process. .

use in the vicinity of the project includes mostly commercial properties. The existing property is being developed into
warehouse space.

The project will require the use of an excavator to lay back the existing slopes which will be seeded and matted. Constructed
riffles with three log J -hooks with boulders will be constructed to deflect the thalwag along with a double drop cross -vane to
hold qrade at the connection of the existing channel.

Explanation: The feature(s) listed above has or have been located on the Soil Survey of Wake County, North
Carolina or the most recent copy of the USGS Topographic map at a 1:24,000 scale. Each feature that is checked
"Not Subject" has been determined not to be a stream or is not present on the property. Features that are checked
"Subject" have been located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but, still may be
considered jurisdictional according to the US Army Corps of Engineers and/or to the Division of Water Resources
(DWR).
This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected
party (including downstream and/or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing. If sending via US Postal Service c/o Karen Higgins DWR — 401 &
Buffer Permitting Unit 1617 Mail Service Center Raleigh, NC 27699-1617. If sending via delivery service (UPS, FedEx,
etc.) Karen Higgins DWR — 401 & Buffer Permitting Unit 512 N. Salisbury Street Raleigh, NC 2760.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner/future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be
directed to the Division of Water Resources (Central Office) at (919)-807-6300, and the US Army Corp of Engineers
(Raleigh Regulatory Field Office) at (919)-554-4884.
