Roberts's property along Pamlico Shores — Chambers Point Road, in Beaufort County. This letter is requesting the issuance of a USACOE NW 18 permit and corresponding DWR 401 certification for the proposed filling of 0.06 acres of wetland on property located along Pamlico Shores — Trade winds development, at the end of Chambers Point Road in Beaufort County. This property is situated along the shores of the Pamlico River consisting of 2.9 total acres. The undeveloped lot is within the Pamlico Shores Community and Trade Winds Property Owners Association. The lot consists of a pine/scrub upland community grading to a lower elevation 404 wetland system, which transitions into a coastal marsh. The jurisdictional wetlands have been delineated and verified by the USACOE and NC DCM. A copy of the approved wetland jurisdictional determination is included in this permit request package. The 2.9 acre lot has been surveyed along with the approved wetland boundaries and proposed Lot A/Lot B configuration. Lot B (1.08 acres) will be retained by Mr. Roberts, while Lot A (1.86 acres) is to be sold. The intent of this request is to create a buildable home site location on Lot B. The proposed home site is positioned to utilize existing upland, while also minimizing fill impacts to the adjacent wetlands. In reviewing Lot B for an available home site, three constraining factors were apparent, one being the western property line boundary, second is the eastern wetland boundary, and third is the 50 ft. Tar-Pam buffer boundary. When considering the placement of a conventional size home structure to avoid property setbacks and Tar-Pam buffer encroachment, it became necessary to consider some supplemental fill to increase the existing upland area and avoid encroaching on property setbacks and Tar-Pam buffers. The allowance of a minimal amount of fill in wetlands is being requested, which will remove the current building site constraints. The proposed amount of fill, after avoidance and minimization is 0.06 acres. Lot B (1.08 acres) has a total of 0.58 acres of wetlands, of which 0.52 acres of wetlands will remain undisturbed. The property owner is only proposing to fill the minimum amount of wetland, necessary to create a buildable home site. Due to the minimal amount of fill being proposed and the area mostly retaining a pervious vegetated state, allowing for rainwater infiltration and diffuse flow, wetland mitigation is not being proposed. All wetlands designated by NCDCM as Coastal, have been avoided. The proposed fill will be brought in by truck from an upland commercial source and placed within the areas shown on the provided permit drawing labeled Fill Area 1, 2, & 3. Prior to this activity taking place, the permitted fill boundary will be clearly staked and erosion control silt fence placed to prevent any loss of material into the adjacent wetlands and prohibiting unauthorized land disturbance. Included with this request letter are the location map, PCN, proposed permit fill plat, county septic improvement permit and photo illustrations of the fill site. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Land use along the Pamlico River water frontage, within the project vicinity, consist of primarily developed residential lots, with a few remaining undeveloped lots. This is an area along the Pamlico river water front from North Creek to Wades Point, a 5 mile section of river frontage. The Roberts property is located within the Pamlico Shores - Trade winds subdivision. Beyond the developed river frontage, timber land is the predominant land use in the area, with some row crop agriculture, which becomes more predominant further inland. 3b. List the total estimated acreage of all existing wetlands on the property: 1.84 acres total out of 2.9 acres (undivided) 0.58 acres total out of 1.08 acres (divided - lot B) 3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property: 175 ft. (Pamlico River Shoreline) 3d. Explain the purpose of the proposed project: The purpose of this project is to provide buildable lot size of approximately 0.16 acres for the construction of a single residential home. 3e. Describe the overall project in detail, including the type of equipment to be used: The proposed project will create a buildable site of approximately 0.16 acres for the placement of a single residential home. The provided permit drawing illustrates the arrangement of an entry drive way adjacent to the western property line, which accesses an upland area located 75-100 feet from the Pamlico river shoreline. This proposed location for a home site retains a 75-100 foot buffer from the shoreline. However, at this location the acreage of buildable upland is constrained by the western property line and the delineated wetland boundary to the east. In order to reduce the building constraint, authorization to place 0.06 acres of suitable fill in the bordering 404 wetland is being requested, which creates a 0.16 acre building site. The allowance of this fill will provide adequate area for the placement of a home site, while retaining the necessary setbacks from the adjacent property line and river frontage. This home site location and proposed fill was reviewed to avoid and minimize impacts to the adjacent wetlands. The proposed driveway access was set to the far western boundary line, avoiding all impacts, except 435 sq. ft. of fill for the entryway to the home site The actual layout of the home site was reduced to a 70 ft. width, moving the fill line west, minimizing the fill to a 2178 sq feet area. Within the proposed divided lot size (Lot B 1.08 acres), of which 0.58 acres are currently wetland, the fill proposal retains 0.52 acres of wetlands on Lot B or 90 % of the wetlands on Lot B. This proposal also completely avoids any coastal wetland fill. The suitable fill will be brought in by truck and placed with a backhoe operation. All grubbing and fill operations will be retained with silt fence to prevent any loss of fill off site and into the adjacent wetland areas. The Proposed building site was reviewed and positioned taking into account the utilization of existing upland area. The site size was dimensioned to only provide building space for a conventional size structure and lawn. Lot "B' totals 1.08 acres, of which only 0.16 has been proposed for a home site, with the remaining portion left undeveloped. We reduced the fill area to 0.06 acres, to keep the amount of fill in wetlands to a minimum and positioned the site to avoid any coastal wetlands and to utilize existing upland area. Lot B, is 1.08 acres in size and currently consist of 0.58 acres of wetlands. The proposed filled has been avoided and minimized to retain 0.52 acres of those wetlands on Lot B. Retaining an adequate setback from the western property line and preserving the 75-100' of buffer zone bordering the Pamlico River was also factored into the home site location. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. During grubbing and filling activity, silt fence will be placed around the disturbed border area, to contain any potential for sediment runoff onto the adjacent wetlands. The contractor will mark of the wetland boundary to delineate the extent of permitted activity. To the maximum extent possible, work will be conducted during dryer times of the year to prevent excess soil disturbance and reduce potential for off-site erosion. 2.
