Please see attached Pre -Construction Notification Application and revised impact exhibits requesting a
Modification of the previously authorized 404 Nationwide Permit 12 & 29 and 401 Water Quality Certification
3884 & 3890. This modification request is a result of the pond draining in the Northwest comer of the site,
which was addressed in the future project plans section of the original application. The jurisdictional pond
did not drain as much as anticipated and therefore additional avoidance and minimization efforts have taken
place around the site plan. Additionally, there were discrepancies in the actual field surveyed data v. GIS
data, which was utilized to design the original site plan. Please note that all BOLD text is updated
information added to the application, and that there are no prosed modifications to the offsite utility areas.

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: Existing conditions onsite consist of forested land with four (4) buffered perennial streams bisecting the
property, and one buffered intermittent stream. Additionally, the site includes jurisdictional wetlands, jurisdictional linear
wetlands and two (2) jurisdictional, ponds. Offsite, the existing conditions consist of jurisdictional wetlands and tributaries
to White Oak Creek. The general land use in the vicinity of the project is rural residential.

Approximately 2.98 acres of jurisdictional wetlands and 2.05 acres of open water exist within property boundaries

The purpose of the proposed project is to construct a residential subdivision and offsite sanitary sewer connection.
Stream and wetland crossings are necessary to access the site and provide utilities.

The overall project consists of the construction of a single-family residential subdivision including all roads, utilities,
walking trail, stormwater BMP's and an offsite sanitary sewer connection. Specifics include three (3) road
crossings, seven (7) sanitary sewer crossings (onsite & offsite) and wetland impacts associated with sewer (onsite
& offsite), road crossing, lot fill and stromwater drainage. Equipment typically used for earthwork and construction
such as backhoes, bulldozers, excavators, graders, pavers etc. will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant contracted with S&EC to complete a wetland and Jordan Watershed Buffer evaluation for the entire property and
the offsite areas in order to identify the natural resources so that the project designers could design a site plan that would
minimize impacts to wetlands, streams and buffers to the maximum extent practicable. The updated proposed project
includes nineteen (18) impact areas that include impacts to jurisdictional wetlands and/or jurisdictional streams. Impact
1 is a proposed road crossing to a perennial stream and wetland. This proposed crossing will result in 78 linear feet of
permanent, 26 linear feet of permanent (no permanent loss) for the dissipater, 10 linear feet of temporary and 0.037 acres of
wetland (permanent + temporary) impacts. The permanent impacts are necessary to provide access from Green Level Church
Road. This crossing has been designed to be a perpendicular crossing and will utilize retaining walls and headwalls to minimize
the stream and wetland impacts. This impact has increased because of actual surveyed stream data vs. GIS data. Impact 2
is a proposed road crossing to a perennial stream. This proposed crossing will result in 116 linear feet of permanent, 16 linear
feet of permanent (no permanent loss) for the dissipater, 42 linear feet of temporary impacts. The permanent impacts are
necessary to provide access the eastern portions of the property. This crossing has been designed to utilize retaining walls and
headwalls to minimize the stream impacts. This impact has increased because of actual surveyed stream data vs. GIS
data. Impact 3 is a proposed road crossing to a perennial stream. This proposed crossing will result in 102 linear feet of
permanent, 42 linear feet of permanent (no permanent loss) for the dissipater, 14 linear feet of temporary impacts. The
permanent impacts are necessary to provide access the northeastern portions of the property. This crossing has been designed
to be a perpendicular crossing and will utilize retaining walls and headwalls to minimize the stream impacts. For all three (3)
road crossings, the temporary impacts are necessary for construction, these areas will be brought back to original stream bed
elevation and the stream banks will be stabilized post construction of the culvert The dissipaters will be constructed such that
the top elevation of the riprap will not exceed that of the pre -construction elevation of the stream bed. This impact has
increased because of actual surveyed stream data vs. GIS data. Additionally, run-off from NC -540 has eroded and
increased the depth of several channels onsite. The vertical alignment of the roadway at Impact 3 was also revised to
minimize impacts. Without the additional impacts, the Town of Apex would not approve the headwall design above the
culvertat Impact 3. Impact 10-2 is a proposed road crossing on a jurisdictional wetland. This proposed crossing will result in
0.046 acres of wetland fill necessary to access lots and a pocket park for the development. Impacts 6. 7, 8. 9. 10-3. 10-4. 10-5.
& 11 are proposed wetland impacts associated with fill activities. Wetland impacts have been avoided and minimized where
possible and retaining walls have been utilized where practicable. Impact 7 increased from 170 SF to330 SF to allow for 1
retaining wall rather than 2 tiered walls; Impact 8 was decreased -lot depth was restricted to minimize wetland impacts;
Impact 10-1 decreased -the BMP dam embankment was regraded and sewer outfall minimized to avoid wetlands; Impacts

areas are temporary impacts to perennial streams, three (3) areas are temporary impacts to intermittent streams and nine (9)
areas are to jurisdictional wetlands. All proposed utility crossings to streams have been designed to cross at a perpendicular
angle. All temporary impacts will be brought back to original stream bed elevation and the stream banks will be stabilized post
construction of the utility crossing. All temporary wetland impacts will be brought back to original contours and re -vegetated with
native species. Impact 14 -the jurisdictional pond was drained. However, the amount of wetland that has reformed at the
bottom was more than anticipated. As such, the alignment of Greemoor Path and Lot Layout has been revised to
relocate a Pocket Park. With the layout revisions and additional efforts of minimization, only a portion of the wetland in
this area is proposed for road impact to allow for street connectivity. The Pocket Park design incorporates retaining
walls to further minimize impacts and shall include a walkway around the wetlands with sitting areas for residents to
enjoy the natural area.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 12 & 29. With respect to
residential development conditions (NWP 29 -Regional Conditions section 4.0) there are no impact associated with single-family
recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream
classification for this project is WS -IV, NSW (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or
wetland adjacent to these waters). With respect to utility line activities (NWP 12 -Regional Conditions section 4 0); Bore & Jack
method is not feasible onsite, Per the project engineer. `sewer depth very shallow at stream crossing to minimize overall depth
of sewer outfall, the Bore & Jack method would require more depth'; Bore & Jack method is not feasible offsite, Per the project
engineer- `The presence of rock would make it very difficult'; Directionally Drill method is not feasible onsite or offsite because of
the required depths/grades of proposed sewer line; any temporary discharges into wetlands during construction activities will be
kept to minimum period of time and will be contained with appropriate erosion control methods; construction corridors not greater
than 40' wide; utilities are not crossing the AIWW,• the utilities are not aerial communication lines, the cleared wetlands within the
construction corridor will be re -vegetated with native species and the permanently maintained corridor has been minimized to 10'

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs " document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The
Greenmoor Subdivision project is a residential development. The property is located within the Town of Apex ETJ,
therefore the adjacent properties that have potential for development will have the following regulations to protect
downstream waters: 1) the Water Supply, Watershed Protection Program which limits development densities as
well as requires protective riparian buffers, 2) the Jordan Watershed Riparian Buffer Protection regulations, these
regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a
minimum, and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved,
and finally 3) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for
Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management
requirements. We anticipate that the DWR will advise us if any additional information is needed.

2. Compensatory Mitigation Using Mitigation Bank and/or NC Division of Mitigation Services
Mitigation must be provided for the proposed impacts as specified in the table below. The
Division has received an acceptance letter from Restoration Systems' Bass Mountain Stream
& Wetland Mitigation Bank and the NC Division of Mitigation Services to meet this

4. No Waste, Spoii, Solid s.or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur. [15A NCAC 02H .0501
and .0502)
Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar high visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15 NCAC 02H.0500. [15A NCAC 02H.0506 (b)(2) and (c)(2) and 15A NCAC
02H.0507 (c))
6. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit a
new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible for
complying with all conditions. [15A NCAC 02B .0507(d)(2))
7. This approval and its conditions are final and binding unless contested. [G.S. 143-215.51
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at

i Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains

On October 3, 2011, Town of Apex (Town) staff visited the subject site to reevaluate previous
buffer calls made by John R. McAdams (JRM) over five (5) years ago. A total of nine (9) drainage
features appear on the USGS Topographic and USDA Soil Survey maps and were evaluated.
Based on the previous buffer calls made in 2006 by JRM and the recent site visit, and per the
requirements set forth in Section 6.1.11 of the Town Unified Development Ordinance, I have
determined the following riparian buffer widths as summarized in the table below.

In March 2006, 1 met with S&EC personnel to evaluate a variety of drainage features in this area
including drainage feature "C' as shown on the attached maps. Feature "C" was determined to
be subject to a 50 -ft riparian buffer beginning at flag "Apex 01". This flag was hung
downstream of the pond dam thus making pond "A" not part of a natural drainage way. Based
on the information obtained during the March 2006 site visit and per the requirements set
forth in Section 6.1.11 of the Town Unified Development Ordinance (UDO), I conclude pond "A"
is not subject to the Town riparian buffer rules.
This on-site determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by the Division of Water Quality (DWQ) or
Delegated Local Authority in the Jordan Lake watershed may request a determination by the
DWQ Director.

Dear Mr. Payne,
On Thursday, March 16, 2006, we met at the subject site to make buffer calls on various drainage
features. Based on the information obtained from the site visit, along with previous investigations
performed by NC Division of Water Quality (DWQ) and US Army Corps of Engineers (USACE), I have
concluded the following:
• Drainage feature "C" is shown on the USDA Soil Survey map as an intermittent stream. This
feature was determined to be perennial by DWQ and USACE. However, the Town of Apex
riparian buffer rules state that buffers will be determined by the most recent version of the USDA
Soil Survey or the USGS Topographic map, therefore, drainage feature "C" will be subject only
to a 50 foot riparian buffer beginning at and continuing downstream of the flag "Apex 01 ".
• Drainage feature "F" will be subject to a 50 foot riparian buffer beginning at and continuing
downstream of flag "T-100".
• Pond 2 is shown on the USGS Topographic map and will be subject to a 50 foot riparian buffer.
• Drainage feature "H" will be subject to a 50 foot riparian buffer beginning at and continuing
downstream of flag "S-1 1".
• Drainage feature "E" will be subject to a 100 foot riparian buffer throughout the site.
• Drainage features "D" and "G" will not be subject to the Town of Apex riparian buffer rules.

We are providing this letter in accordance with 33 CFR §332.8(r), to confirm that .06 Riparian Wetland & 24 Stream
Mitigation Credits (Credits) from the Cripple Creek Stream & Wetland Mitigation Bank (Bank) are currently
available and may be used, once transferred, for compensatory mitigation relative to the Greenmoor project, and
as proposed by Pulte Homes Corporation (Applicant).
The Applicant may ultimately purchase the Credits, if they are available, following Permit issuance. Should the
Applicant purchase the Credits at that time, we will complete and execute the Compensatory Mitigation
Responsibility Transfer Form (Transfer Form) within five (5) days of receipt of the full purchase price.
We will additionally provide copies of the completed and executed Transfer Form to the Applicant, the Bank's US
Army Corps (USACE) Project Manager and, if needed, other regulatory agencies. In addition, we will provide USACE
with an updated copy of the Bank's Ledger, reflecting the transaction. Transaction information in the updated Bank
Ledger will include relevant Permit and Applicant information as well as the number and resource type of the debited
Credits.
