Horton, Inc., we are requesting authorization from the USACE to use NWP 18 for 0.041 acres of permanent wetland impacts for construction of a greenway within Phase 2 of the Edgemont Landing Subdivision. We are also requesting a 401 WQC and buffer authorization for 14,789 sq. ft. of permanent impacts to riparian buffers for construction of the proposed project. Please note that the proposed project will result in fill within the 100 -year floodplain, which is prohibited by the Regional Conditions of NWP 29, and therefore we are requesting authorization under a NWP 18 which does not prohibit such activities. The project is ±64 acres in size and consists of three parcels located west of Osprey landing Drive adjacent to Sandpiper Farm Lane in the Edgemont Landing Subdivision in Wendell, Wake County (Latitude: 35.805372°N; Longitude: -78.406910°W). The project is located in the Neuse River basin and onsite waters drain to Buffalo Creek. The Water Quality Classification for Buffalo Creek is Class B; NSW and the Stream Index Number is: 27-57-16-(2). The hydrologic cataloging unit for the site is 03020201. Proposed Project The purpose of the proposed project is to complete phase 2 of the existing Edgemont Subdivision and to meet the growing demand for single family residential housing in Wendell. The proposed project consists of the construction of a 150 lot single family residential subdivision, recreational amenities and associated infrastructure including road, utilities and stormwater management. The proposed impacts are specific to construction of a greenway trail within the northern portion of the project. Your Succuss. Edgemont Landing Phase 2 consists of the final phase of the Edgemont Landing Subdivision in Wendell, NC. The Corps of Engineers issued a Preliminary Jurisdictional Determination (AID: SAW -2007-01102) for the project site on 05/09/16. A copy of the Preliminary JD has been provided as an Appendix. NCDWR issued a Buffer Determination Letter (NBRRO#16-094) for the project site on 04/13/16. A copy of the Buffer Determination Letter has been provided as an Appendix. The construction of the previous phase of the Edgemont Landing Subdivision resulted in impacts requiring authorization from the Corps of Engineers and NCDWR. In 2007, the Corps of Engineers issued NWPs 33 &39 (AID: SAW -2007-1102-292) for Phase 1 of the Edgemont Landing subdivision authorizing 178 If of permanent stream impacts and 0.041 acres of permanent wetland impacts for construction of the original phases of the development. Additionally, NCDWR issued a 401 WQC & Buffer Authorization for Phase 1 of the Edgemont Landing Subdivision in 2007 (DWQ Proj #06- 1945) authorizing the aforementioned impacts, as well as 12,400 sf of permanent riparian buffer impacts for the previous phases of the development. The authorizations required 178 If of stream mitigation to be provided, which was purchased prior to construction of the authorized impacts. Copies of the NWP 33&39 and NCDWR 401 WQC & Buffer Authorizations have been provided as Appendices. Proposed Impacts The proposed impacts consist of 0.041 acres of permanent wetland impacts and 14,789 sq. ft. of permanent impacts to riparian buffers (Zone 1: 2,069 sq. ft.; Zone 2: 12,720 sq. ft.) for the construction of a greenway trail in the northern portion of the project. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. The proposed permanent wetland impacts have been minimized to only those necessary for construction of the greenway trail adjacent to Lot 250. The greenway trail was designed to minimize wetland impacts by aligning the greenway trial to abut the rear property lines of Lots 250 & 251. Greenway easements cannot be platted on private lots, and therefore the greenway could not be moved further uphill to completely avoid wetland impacts. Additionally, the greenway trail has been designed to utilize an elevated pedestrian bridge to cross the intermittent stream to avoid stream impacts at this crossing. Impacts to riparian buffers have been minimized by keeping the greenway out of the buffers where possible while avoiding adjacent lots, as well as crossing the buffers perpendicularly. More specifically, the cumulative permanent wetland impacts will be less than 0.10 acres, and therefore the proposed project is eligible for a NWP 18. Mitigation Wetland Mitigation The cumulative wetland impacts for the Edgemont Landing subdivision area less than 0.10 acres. Therefore, there is no proposed wetland mitigation for the currently proposed 0.041 acres of permanent wetland impacts. Riparian Buffer The impacts to riparian buffers from construction of residential lots and greenway trail are categorized as "Allowable," and do not require mitigation. Stormwater Management Plan The Stormwater Management Plan for Phase 2 consists of two stormwater wetlands, which will provide TN and TSS removal and will discharge at non-erosive rates. Site reviews did not identify any potential habitat for any federally protected species known to occur in Wake County, except for the Northern Long Eared Bat. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. Since the entire project area consists of mature forest over 3" DBH, there is potential northern long eared bat habitat present. The USFWS Final 4(d) rule for the Northern Long-Eared bat specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft- radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, clearing of mature forest between June 1st and July 31st is not anticipated for construction of the proposed project. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect" the northern long-eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
