Sullins, Director Division of Water Quality February 14, 2008 DWQ# 07-1833 Forsyth County Mr. Trip Bunker Landcraft Management, LLC 603-F Eastchester Dr. High Point, NC 27265 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Bunker: You have our approval, in accordance with the attached conditions, to place temporary fill in 201inear feet of stream, to place permanent fill in 129 linear feet of stream, to place 0.02 acres of fill in two jurisdictional wetlands, and to place fill in 0.05 acres_ of an existing pond, in order to construct the Youngs Hill Subdivision located on Payne Rd near High Point in Forsyth County, as described in your application received by the Division of Water Quality (DWQ) on October 25, 2007. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3631, which can be viewed on our web site at http://www.ncwaterquality.org/wetlands.html. This Certification allows you to use Nationwide Permit Number 29 when it is issued by the U.S. Army Corps of Engineers. In addition, you should secure any other applicable federal, state or local permits before you proceed with your project, including (but not limited to) those required by Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. Also, this approval will expire when the accompanying 404 permits expire unless otherwise specified in the General Certification. This approval is valid only for the purpose and design that you have described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fill for this project (now or in the future) exceeds one acre, or total fill to perennial streams equals or exceeds 150 linear feet, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Pipe alignment should be designed and constructed to ensure future integrity of the stream above and below the crossing. Pipes should be in alignment with natural channels or adjusted to prevent scouring of downstream banks due to pipe installation. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. 3. The proposed project must comply with the City of High Point local water supply ordinance approved by the N.C. Environmental Management Commission (EMC) as required under the Randleman Lake Water Supply Watershed: Protection and Maintenance of Riparian Areas (Randleman Buffer Rule) 15A NCAC 02B .0250. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0250(5) 4. The Permittee shall submit a valid approval letter from the City of High Point indicating that the proposed activity has an approved stormwater management plan (SMP) which includes provisions for ensuring diffuse flow, and one copy of the approved SMP, including plan details, calculations and other supporting information, prior to commencing any impacts approved by this certification. 5. Upon finishing the project, the Applicant shall fill out and return the enclosed "Certificate of Completion" to notify NCDWQ when all work included in the §401 Certification has been completed. This certificate should be returned to the Winston-Salem Regional Office of the NCDWQ at the address listed on the form. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
