Division of Water Resources" $240.00 for 401 Water Quality Certification with minor impacts $570.00 for 401 Water Quality Certification with major impacts Express Review Fee (Amount requested on Acceptance Letter) Four (4) complete and collated copies of the PCN Application and supporting documentation (instead of providing 4 copies of the full size plans you may provide two copies of full size plans along with two copies of 11 X 17 plans) Stormwater Management Plan (if applicable — see PCN Form Help File Section E) 1) Please provide three (3) copies of the stormwater management plans along with all supporting information pertaining to this project including the following: a. Entire site development/layout plans delineating all drainage areas; b. Design calculation sheets for all proposed PMP(s) sized for both onsite and off-site drainage; c. BMP supplements for each proposed BMP and Required Items Check List (httpJ/porta 1.ncdenr.org/web/ir/bmp-manual) along with all required items; d. A Notarized Operation & Maintenance Agreement for each stormwater management facility; e. Detailed construction drawing sheets shall include (i) Erosion and sediment control plans; (ii) Installation and planting schedules for the proposed BMPs; (iii) Appropriately scaled plan views and cross sectional details of all BMPs and associated components — inlet and outlet structures, forebay, respective zones and pertinent elevations. If your project is located within a State implemented Riparian Buffer Rule Area, submit the following alone with site plans and PCN form: 1) Three (3) copies of the details for on-site diffuse flow provisions, (refer to h ttp:l/portal, node nr, org/web/l r/lamp-manual), Z DWR Stream Determination Forms for streams an property and aWR determination letter for wetlands or streams (if applicable). The following is the most critical of all the information that you must provide. The quality and detail of the information will often determine the expeditiousness of the review. The following is a checklist of the types of pertinent information required at a minimum: Maps and Plans: The most recant_ version of the 1:24,000 USGS Topographic Map - Please cleanly draw or delineate the site boundaries can the topographic map. Z The most recent version of the bound and published County MRCS Soil Survey Map - (required for projects within the Neuse River Basin, Tar -Pamlico River Basin, Randleman Lake Watershed and the Catawba River Basin; also recommended for all projects) - Please clearly delineate the site boundaries, etc. on the map. If the delineation obscures any of the features, it is recommended that a clean copy be provided. Copies of the Version 1.4 January 9. 2009 current sail survey and/or soil survey map sheets can be obtained from the local N'RCS County Office (ht­tp:llwww.nc.nres.usda.gov/). GIS soil layers are not acceptable_ Vicinity map - Please clearly mark the location and approximate boundaries of the property and project on the map. Please indicate north arrow and scale. Please include applicable road names or State Road numbers. The Site Plan - The most critical map to be provided is the site plan. You must provide full sized plans. The following is the minimum list of plans that are typically needed. Z Pre-construction/Pre-existing conditions - This sheet (or sheets) must include: • All jurisdictional and non -jurisdictional wetland, stream, water features, State regulated buffers (delineated into Zones 1 and 2) • Topographic contours with elevations • Any existing structures and impervious areas • Existing utility lines and easements • Existing reads, culverts, and other pertinent features • North arrow and the scale (1":5Q' scale is recommended). Proposed conditions - This sheet (or sheets) must include: • All jurisdictional and non -jurisdictional wetland, stream, water features, State regulated buffers (delineated into Zones 1 and 2) • Lot layout (if a subdivision or commercial development is proposed) - lets must be developable without further impacts to iurisdictional and non -jurisdictional wetlands, streams water features and State regulated buffers, Building envelopes must be provided when streams, wetlands, riparian buffers, or water features exist on a lot • All built -out structures and impervious cover • Final grading contours with elevations • All utilities and easements (including septic fields on all lots within 100 feet of stream, wetland, or water features - if applicable) • Impacted areas — these should correspond with the Impact numbers listed on your PCN form. �i drainage Plans - Final drainage plans must include the following: 11�� • Locations and pertinent elevations and sizes of the stormwater collection system and drainage ways • All inlets and outlets must also be shown with pertinent elevations (All outlets to wetlands must be at a non-erosive velocity, generally less than 2 ft/sec during the peak flow from the 10 -yr storm) • Scaled stormwater BMPs must also be indicated as required by DUMB rules and policies • In certain cases (see Section E of PCN form), final stormwater management plans must also be provided (see Stormwater Management Plan Checklist) Proposed Impacts - All impacts to jurisdictional and non -jurisdictional wetland, stream, water features, and State regulated buffers must be shown and labeled on the site plans at a scale no smaller than 1" = 50'. All excavation, fill, flooding, stabilization, and other impacts that will be conducted in or near jurisdictional and non -jurisdictional wetland, stream, water features, and State regulated buffers must be indicated. Please provide crass sectional details showing the previsions for aquatic life passage (burial of culvert 20% for culverts :5 46 inches, and 1 -foot for culverts > 48 inches). Version 1-4 January 9, 2009 Wetland Impacts: NIA ❑ Precise grading and final elevation contours must be provided. Existing vegetation and any clearing must be specified. ❑ All subsurface utility lines must indicate the location of anti -seep collars. Construction detail for anti -seep cellars must be provided. ❑ Roadway or other crossings of riparian wetlands may require floodway culverts to maintain existing hydrological conditions. ❑ Flans should show that the hydrology of remaining wetlands on the site will be maintained. Stream Impacts: ® Stream impacts must be clearly shown on the plans. The centerline as well as the banks of the stream must be surveyed or located by GPS for the portion of the stream to be impacted. The inlet and the outlet of all culverts should be aligned with the stream as much as possible. Inlet and outlet elevations and streambed elevations should be indicated. Any inlet or Nutlet protection must be shown and enumerated on the impact map(s). For bottomless culverts or other spans, a vertical cross section should be provided that shows the minimum distance from each span to each stream bank, the stream cross section, the height of the span above the stream and the minimum distance from the edge of each footer to each stream bank. Additionally, please provide a signed and sealed geotechnical report of subsurface soils at the proposed bottomless culvert location. The report must comply with the Division of Highways — Guidelines for Drainage Studies and H_y draulic Design, prepared by A.L. Hankins, Jr., State Hydraulics Engineer - 1999. Al Multiple culverts or sectioned box culverts typically require the use of sills, off- setting or other means to match the cross section of the existing stream (in order to maintain stream stability and provide aquatic life passage). A vertical cross section of the culverts should be shown overlain with the up and downstream stream cross section including the stream flood -prone area. Impacts associated with dam construction must indicate and enumerate all fill associated with the dam footprint, spillway and any bank stream bank stabilization. Simmons Branch is a highly urbanized stream that is constrained by residential housing on one side and a roadway on the other. The existing culverts that service the reach of interest are significantly undersized for the flow that they need to convey. This area experiences significant stormwater flows from a developed neighborhood with minimal habitat value and little to no natural existing buffer. See attached sheet for more. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. In order to minimize the environmental impacts during construction the existing Swift Drive culvert will remain in service until the proposed culvert is constructed: This is possible due to the new proposed alignment for the Swift Drive culvert, This eliminates the need for a pump around at this location and provides uninterrupted flow In Simmons Branch throughout constructlon. The project will consist of two culvert replacements, a driveway bridge replacement, re-routing sanitary sewer, relocating water services and gas main as well are relocating power poles. Modular reinforced segmental wall and riprap will be used as a stream stabilization technique and step pools will be utilized downstream of the upgraded culverts. Equipment will likely include trucks, trailers, backhoes, cranes, concrete trucks, dozers, pavers and pump systems. It should be noted that the Swift Drive culvert alignment will be altered and that a variance to avoid burying both culverts 1 -ft is being sought. 3i. encountering bedrock during construction. Additonal informaiton about the requested variance can be provided upon request. 4a. An environmental investigation performed by ESI indicated that no wetlands were present and the 4 tributaries to Simmons Branch would not be subject to buffer rules while Simmons Branch would be subject to buffer rules. It was further determined that no mitigation would be required due to the current state of the stream and the proposed project being considered maintenance. This was decided at a field meeting on Friday October 13, 2006. DWQ issued a finding on October 17, 2006 that confirmed this conclusion. DWQ project number NBRRO 06-258 (County: Wake). A copy of the determination from DWQ has been included with this submission. 5a. Stream determination was determined on October 13, 2006 and issued in letter NBRRO 06-258. All previous approvals / determination have been included with this submission. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. The residential neighborhood in which the stream is located floods on a regular basis. The Swift Drive culvert is currently failing. The stream banks are currently unstable and eroding at several locations and contributing to sediment load downstream. Utility conflicts exist within the open channel and existing culverts. Through an evaluation of alternative design scenarios it became apparent to the City of Raleigh that they would need to replace and upgrade the existing culverts and the downstream driveway bridge in order to maintain the conveyance of this stormwater system. During the design for replacement of structures it was determined that in order to stabilize the banks with residential houses so close on one side and a roadway close on the other side that reinforced modular walls would be needed. Several existing utility conflicts were also noted and the proposed design minimizes proposed utility conflicts with the stormwater system. With the exception of installing the drainage system's primary concrete box culvert on the opposite side of the Swift Drive, the remainder of the project mimics the existing drainage system in terms of location of open channel, bridges and culverts. Drainage calculations show velocities approaching 10 to 12 feet per second in the open channel for the 2- and 10 -year flood events respectively. Shear stresses for this reach exceed the permissible velocities for a natural open channel therefore the project is proposing to line several open channel sections with rip -rap and construct four plunge pools. Due to property owner and roadway ROW constraints, redesigning the channel to include floodplain benches was not a viable alternative to reduce channel velocities and shear stresses. 1 b. A pump around will be used during the Pineview Drive culvert replacement and the downstream driveway bridge replacement. The pump around technique will insure that all construction is performed in the dry and that no construction materials are introduced the flowing body of water. Due to the current flooding issues of the neighborhood, risk to public safety, and the close proximity to the roadway the impacts of the project are considered justifiable by the City of Raleigh and are thought to be a necessary maintenance project for their stormwater conveyance system. Also, by constructing the primary concrete culvert on the opposite side of the road, the contractor will be able to work in the dry for approximately 66% of the 15 month construction time period. This will allow the base and storm flows to pass through the existing 8'x5' RCBC and avoid major damage to the construction work zone (delays to the project) and unnecessary channel bank erosion. In addition, the proposed plans call out a pump around for those sections of the drainage system that cannot be constructed in the dry. At your request, ESI has conducted a jurisdictional wetland and stream delineation and Neuse River Riparian Buffer evaluation for the Swift Drive and Pineview Drive Culvert Replacement Projects along Swift Drive for approximately 750 linear feet. The project site begins 50 feet upstream of the Pineview Drive driveway bridge and ends 50 feet downstream of the second Swift Drive driveway bridge. For the purposes of this study, ESI identified and delineated all jurisdictional areas extending 50 feet from the top -of -bank on each side of Simmons Branch (including Simmons Branch) in Raleigh, Wake County, North Carolina (Figure 1). The project site is located in the Neuse River Basin. The project study area was reviewed on 26 June 2006 by ESI biologist Lauren Cobb. Ms. Cobb is a Senior Scientist with a B.S. in Natural Resources and more than six years of professional experience. Prior to the initiation of field efforts, available resources were reviewed, including the appropriate U.S. Geologic Survey (USGS) 7.5 -minute topographic quadrangle (Raleigh West, NC) and Natural Resources Conservation Service (NRCS) soil mapping for Wake County, North Carolina. Jurisdictional Evaluation The project site was reviewed for the presence of jurisdictional stream channels using criteria provided by the U.S. Army Corps of Engineers (USAGE) and the N.C. Division of Water Quality (DWQ). The project site was also reviewed to determine the presence or absence of jurisdictional wetland areas using the three -parameter approach (hydric soils, hydrophytic vegetation, and evidence of jurisdictional hydrology) as outlined by the USACE 1987 Wetlands Delineation Manual. Based on this approach one stream channel (Simmons Branch) was identified within the project site. ESI delineated Simmons Branch by hanging orange and blue flagging tape along each side of the jurisdictional channel. Attached is a list of the line sequences used and a graphic depicting the approximate location of jurisdictional areas (Figure 3). A large portion of Simmons Branch JACKSONVILLE • ST. AUGUSTINE • COCOA • JUPITER • DESTIN • SAVANNAH • ATLANTA • RALEIGH • CHARLOTTE • ASHEVILLE ENVIRONMENTAL SERVICES, INC. appears to be piped north of Swift Drive. Therefore, only the western and eastern portions of Simmons Branch within the project site were accessible to delineate. On the day of the field visit, Simmons Branch had little to no turbidity and swift flow. The substrate consists of sand and cobble with multiple culverts for residential driveways and road crossings. The DWQ Stream Identification Form Version 3.1 served as the basis for determining whether Simmons Branch is intermittent or perennial. Using this form, Simmons Branch was evaluated based on three characteristics (Geomorphology, Hydrology, and Biology) and assigned a numeric score. Simmons Branch scored a 36 and is therefore considered a perennial stream based on current DWQ methods. To aid in alternative analyses and to help determine stream mitigation requirements, the USACE designates streams as either Important or Unimportant. Streams that have perennial flow, associated wetlands, significant aquatic fauna, or associated Threatened and Endangered species are generally considered to be Important and impacts to these streams would require mitigation. Intermittent streams may be considered Important if the associated wetlands, significant aquatic fauna, or Threatened and Endangered species criteria are met. Streams designated as Unimportant do not typically require mitigation. It is in ESI's opinion that the USACE would consider Simmons Branch Important based on current USACE criteria. Based on current USACE criteria, no jurisdictional wetland areas were identified within the project site. The project study area is located within the Neuse River Basin; therefore, streams and surface waters (i.e., ponds, lakes, etc.) depicted on the most recent versions of USGS topographic maps or county soil survey maps are subject to the Neuse River Riparian Buffer Rules. Certain activities within the 50 -foot riparian buffer are regulated by DWQ and will require their approval. The riparian buffer consists of two distinct zones. Zone I comprises a 30 -foot wide area adjacent to the surface water that cannot be disturbed except for those specific activities that are allowed by the Neuse River Riparian Buffer Rules. Zone 2 comprises a 20 -foot wide area adjacent to Zone i that is to be left undisturbed except for those specific activities allowed by the Buffer Rules. Grading and re -vegetating Zone 2 is allowed provided that the condition of Zone 1 is not compromised. Simmons Branch is mapped on the county soil survey and the USGS topographic map and is subject to the Neuse River Basin Buffer Rules, In addition, four other drainage features are depicted on the county soil survey flowing into Simmons Branch (Figure 2). It is in ESI's professional opinion that these drainage features are not jurisdictional streams within the project site and should not be subject to the buffer rules. However, DWQ should review these features to determine whether they are subject to the buffer rules. The jurisdictional delineation should be approved by the USACE prior to impacting any jurisdictional areas. Unavoidable impacts to Section 404 jurisdictional areas will require Section 404 and Section 401 permitting. Approval from the DWQ is required prior to impacting buffers along streams that are subject to the Neuse River Riparian Buffer Rules. ESI will request USACE and DWQ concurrence pending consultation with Dewberry & Davis, Inc.
