Sullins, Director Division of Water Quality February 14, 2008 DWQ Project # 2004-0108v2 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED McCar Homes Attn: Mr. Ryan Shirley 15401 Weston Parkway Suite 175 Cary, NC 27513 Subject Property: Miramonte Greenway, Apex, NC UT to Middle Creek [030202,27-43-15-(1), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Shirley: On February 6, 2008, the Division of Water Quality (DWQ) received your application dated February 6, 2008 to impact 3,095 square feet (ft) of Zone 1 of the protected riparian buffers and 2,391 square feet (ft) of Zone 2 of the protected riparian buffers to construct the proposed greenway at the subject property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 213 .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. It appears the portion of the greenway leading to the pedestrian bridge #I can be reconfigured to minimize impacts to the protected riparian buffer. 2. It appears that the buffer impact labeled as "Impact Area #2" on your plan sheet can be reconfigured to avoid the impacts to the protected riparian buffer. 3. This Office believes that the width of the proposed greenway trail can be reduced to minimize the impacts to the protected riparian buffer. Please revise your plan sheets to reflect the above requested changes. Please respond within three weeks of the date of this letter by sending this information to me in writing and Lauren Witherspoon of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
