Kevin:
We issued a 401 for this site, and it included on-site restoration of 570 LF of stream. The 401 was
issued on July 16. In October we got a request for a permit modification involving the mitigation
plan. According to the letter when Baker completed the design, it was only going to result in 440 LF
of stream restoration. So they got a letter from EEP to cover the 130 LF of credit.
So now we have a February 7, 2008 letter from Clement saying that they want to withdraw the request
for modification, and they are back to 570 LF. I compared the plan sheets and the plans are pretty
much identical to the plans submitted in October.
I would say we need to ask for an explanation.
