Public Meeting for Weatherspoon Power Station
6 p.m. March 10, 2016 — Robeson Community College, A.D. Lewis Auditorium, 5160 Fayetteville
Road, Lumberton, N.C.
This meeting is called to order.
Good evening. My name is Shawn McKee. I have been appointed by the North Carolina Department of
Environmental Quality to preside at this public meeting. I am an environmental senior specialist
in the Solid Waste Section of the N.C. Division of Waste Management, which is part of the Department
of Environmental Quality.
I am joined tonight by other staff from the N.C. Department of Environmental Quality. They are:
• Elizabeth Werner, permitting hydrogeologist with the Division of Waste Management
• Jamie Kritzer, public information officer with the department and Division of Waste
Management
• Ed Mussler, permitting branch supervisor in the N.C. Division of Waste Management
• Shannon Aufman, permitting environmental engineer in the Division of Waste Management
• Larry Frost, permitting engineer with the Division of Waste Management
• Drew Hammonds, environmental senior specialist with the Division of Waste Management
I appreciate everyone's attendance tonight and would like to take this time to recognize any public
officials in attendance tonight.
(Staff from the registration table will provide a list if any elected officials sign in.)
At this time, I invite any additional elected officials to stand and introduce themselves.
This meeting is being held under the authority of North Carolina General Statutes Chapter 130A-
309.200 and 130A-309.213, which requires the department to develop proposed classifications for all
coal combustion residuals surface impoundments, including active and retired sites, for the purpose of
closure and remediation. Within 30 days of the receipt of all public comments, the department must
finalize its recommendations for classifications for coal combustion residuals impoundments at Duke
Energy facilities statewide. Those recommendations will then be submitted to the Coal Ash
Management Commission for consideration and final approval.
As meeting officer, it is my responsibility to listen to your comments and assist in the preparation of a
report, which summarizes the information presented tonight and provides recommendations on the
classification of coal combustion residuals impoundments at the Weatherspoon Power Station. To aid
the department in preparing the report, audio of tonight's meeting is being recorded. In addition, I ask
that you provide me with a written copy of your comments if possible. Comments should be relevant to
the issue of coal combustion residuals impoundment risk classification for the Weatherspoon Power
Station in order to be considered in the final recommendation.
At this time, I will provide an overview of how the meeting will be conducted:
1. Staff will give a presentation which summarizes the draft risk classification for the Weatherspoon
Power Station. Following the staff presentation, I will hear all oral comments relevant to the issue of
coal combustion residuals impoundment risk classification for the Weatherspoon Power Station.
2. I will call on speakers in the order they signed up to speak.
3. Each speaker will be limited to 5 minutes.
(Adjust the time limit as needed if a very large crowd attends.)
4. There will be no cross-examination of speakers or division staff.
5. All public comments will be directed to me as the meeting officer.
6. I ask that everyone respect the right of others to speak without interruption.
At this time, I will give a brief summary of the risk classification for the Weatherspoon Power Station.

At this time we will hear from audience members who wish to speak in the order that they registered.
Please limit comments to 5 minutes so that everyone who wishes to speak has an opportunity to do so.

The department may only consider technical and scientific information related to the risk classification
of the Weatherspoon Power Station when making recommendations for the final classification. Other
issues concerning this facility or the issue of coal combustion residuals as a whole are beyond the scope
of this public meeting.
When your name is called, please come to the podium, state your name and indicate any group you may
be representing or affiliated with. To ensure that we hear from all who wish to speak, there will be a 5
minute time limit for providing comments. Staff will keep track of the time and raise a sign to indicate
when you have one minute remaining and when you have 30 seconds remaining to finish your
comments. Please keep your comments concise and limit them to the issue of coal combustion residuals
impoundment risk classification for the Weatherspoon Power Station. I appreciate your cooperation in
complying with these requests.

That concludes tonight's line-up of speakers. We have use of this meeting room for a set time period, sc
department staff will not be available for questions or comments after the meeting. However, comments
may be submitted through April 18 by sending an email to: weatherspooncommentskncdenr.gov.

After careful study of all comments received and the requirements of state laws and administrative rules,
the department will make a recommendation based on this meeting on the coal combustion residual
impoundment risk classification for the Weatherspoon Power Station.

Background:
• Under the Coal Ash Management Act (CAMA) of 2014, all coal ash
impoundments in North Carolina are required to be closed.
• The deadlines for closure depend on the classification of each
impoundment as low, intermediate, or high.
• CAMA required the Department of Environmental Quality (DEQ) to make
available to the public a summary of the initial draft proposed
classifications in December 2015, and a full report in January 2016.
• These draft proposed classifications are based on the information
available to the department as of January 2016 and are posted on the
departments website, local library, and health department.
• The draft proposed risk classification for the W. H. Weatherspoon Power
Plant is Intermediate.
• Following completion of the public meetings and the submission of
comments, the Department will consider the comments and develop final
proposed classifications.

After the release of the summary of the initial draft proposed classifications,
CAMA requires the following process:
• DEQ must make available a written declaration that is a detailed report
explaining the technical and scientific background data and analyses
behind the draft proposed classifications.
• Publish a summary of the detailed report in the local newspapers.
• Make the report available to the local health director and accessible at the
local library.
• A public meeting in each county with a coal ash facility.
• Consider all public comments and develop final proposed classifications.

Closure Deadlines
High risk impoundments: Dec. 31, 2019
• Closure plan due by Dec.31, 2016
• Intermediate risk impoundments: Dec. 31, 2024
• Closure plan due by Dec. 31, 2017
Low risk impoundments: Dec. 31, 2029
• Closure plan due by Dec. 31, 2018

Four of Duke's 14 facilities are designated as high -risk by the coal ash law.
Under CAMA, the department is required to consider the following factors,
at a minimum, in proposing classifications for the remaining 10 facilities:
1. Any hazards to public health, safety, or welfare.
2. Structural condition and hazard potential.
3. Consideration of surface
4. Consideration of groundwater.
5. The location and nature of all receptors.
6. All factors influencing the movement of contaminants.
7. Consideration of coal combustion residuals in the impoundment.
8. Position in 100-year flood plain
9. Any other factor the department deems relevant to the establishment of risk.

The department incorporated all of the preceding criteria into three primary
categories that were used to evaluate each impoundment:
• Structural Integrity
• Impact to Surface Water
• Impact to Groundwater
The draft classification process was iterative and took place over months.
Recommendations regarding the impoundments were amended and
updated as additional scientific and technical information was received,
reviewed and verified.

Overall Draft Risk Classification
DEQ has proposed the risk classification for the Ash Pond as
INTERMEDIATE.
Groundwater Key Factor: Based on the information received to date,
there appears to be no downgradient receptors located 1,500 feet
downgradient of the impoundment compliance boundary.
• Surface Water Key Factor: The impoundment at the facility is located
within the 100-year floodplain.
• Dam Safety Key Factor: The impoundment received a low high risk
ranking before any repairs are made and a low risk rating once repairs are
made.
• Other factors and considerations associated with groundwater, surface
water, and dam safety were evaluated as part of the risk classification
process.
