Sullins, Director Division of Water Quality February 4, 2008 DWQ# 93-1059 ver. 2 Guilford County CERTIFIED MAIL: 7007 0220 0004 0732 6561 RETURN RECEIPT REQUESTED Mr. Robert Ponton Larco Construction PO Box 16279 Winston-Salem, NC 27115 Re: Section 401 Water Quality Certification modification for the Larco Construction Company Dear Mr. Ponton: On December 4, 2007, the North Carolina Division of Water Quality (DWQ) received your application for a 401 General Water Quality Certification modification to impact 1491inear feet of stream and associated riparian buffers to construct the Larco Construction Co. plant expansion near High Point in Guilford County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. The DWQ will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. 1. The Division is unable to issue a 401 Water Quality Certification in violation of the Randleman Watershed Riparian Protection Rules. We understand that you are currently seeking a major variance from these regulations. We will continue to review this project upon notification that a variance has been granted, or upon submittal of any amended documents that would indicate the variance would no longer be needed. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
