REQUEST FOR MORE INFORMATION
Dear Mr. Shank:
On October 26, 2007, the Division of Water Quality (DWQ) received your application dated
October 23, 2007, to fill or otherwise impact 150 linear feet of intermittent stream, and 8,030
square feet of Zone 1 Neuse River basin protected riparian buffers and 4,837 square feet of Zone
2 Neuse River basin protected riparian buffers to construct the proposed residential subdivision.
On January 18, 2008, the DWQ received additional information from you, however, the DWQ
has determined that your application remains incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore,
unless we receive five copies of the additional information requested below, we will have to
move toward denial of your application as required by 15A NCAC 2H .0506 and will place this
project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. Please correct the following two issues regarding the labeling on the plans:
a. The correct term for the BMPs you are proposing is "bioretention areas," not
"bioretention ponds."
b. The plans should not be labeled as "preliminary."
2. Please show the pipes connecting the underdrains with the bypass channels on the plans.
3. Please provide details for the flow splitter devices you are planning to use.

4. For each of the proposed Bioretention Areas, please provide a Required Items Checklist
(the second worksheet of the Bioretention Supplement Form) as well as any required
items that were omitted in the most recent submittal. Some of the required items that
need to be included are: the construction sequence, the proposed drainage easements, the
maintenance accesses, and the fertilizer and watering specifications to establish the
centipede sod. The soils test is not required in this case due to your decision to use
underdrains.
Please submit this information within 30 calendar days of the date of this letter. If we do not
receive this requested information within 30 calendar days of the date of this letter, your project
will be withdrawn and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian
