PROJECT SUMMARY: The applicant is proposing to construct a 19.67'x19.67' stationary platform for science research ~,. NC State University Page 2 9. ~iarrative Description The NC State University project is located on Pamlico Sound just 3.5 miles north of the existing Cedar Island Ferry route at Longitude 76 17.1 W and Latitude 35 04.6 N. The site lies on the northwest side of Pamlico Sound in this area. The proposed project is located entirely over open water on Pamlico Sound. The current water depth is -20 ft at NWL. No landmasses or marsh are within 3.5 miles of the project area. The width of Pamlico Sound is 25 miles wide per the NOAH Nautical Chart-11548. Divers from UNC-IMS and UNCW on 2/8/08 performed a bottom survey. No Shellfish, fish habitat, or SAV's were observed and the project area consists of a muddy substrate. The Coast guard has been contacted by the applicant and has been informed of their requirements. The Division of Water Quality classifies this area as SA and HQW waters. This area is not a Primary Nursery Area. This portion of Pamlico Sound is open to the taking of shellfish. There are no shellfish leases in this area per Mike Marshall with DMF. 10. Proiect Description: The applicant is proposing to construct a 19.67'X19.67' stationary science research platform. There will also be a 6'x6' instrument house enclosure, antenna towers, solar panel, wind turbine and various scientific instrumentation to measure water quality, atmospheric conditions and marine habitat. Water depths around the proposed platform average - 20.0'NWL. The combined platform area of the dock would be 387ft2 and the square footage for the enclosed instrument house would be 36 ft2. The proposed location is 3.5 miles north of the Cedar Island Ferry route with no marsh or landmasses. The platform would not be a hindrance to navigation and the applicant is in the process of permitting from the USCG. 11. Anticipated Impacts: This proposed platform would result in 387ft2 of open water incorporated while shading 387ft2. An increase in turbidity will occur while setting pilings. There should be no hazard to navigation resulting from this project due to the requirements of installing a slow flashing white light with NB day boards on all four sides per the USCG. The proposal is to construct an 19.67'X19.67' stationary science research platform. There would be a total of 387ft2 of platform space for the entire project. There should be no hazard to navigation. Therefore, I recommend the project be authorized as proposed, contingent upon the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become. a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on; in or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 4. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5. This permit does not authorize the excavation or filling of any vegetated wetlands or open water areas. 6. The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. Tory and Dave did the reconnaissance dive and found a flat, featureless, mud bottom, during a a 25 foot radius sweep of the area around the center of the proposed platform site. There was no SAV (sub aquatic vegetation), no shellfish beds, or anything else that would prevent us from using this area. I will complete the permit and get that back to CAMA on Monday.
