The purpose of this letter is to respond to your Request for More Information letter dated
January 15, 2008. The original questions/requests are copied below as they appear within
letter and are then followed by our response.
Additional Information Requested.
The riprap level spreaders that are proposed at the outlets of wet detention basins 3, 4, 5
and 6 do not meet the current state standards for diffuse flow. Please redesign these level
spreaders with concrete lips per Chapter 8 of the NC Division of Water Quality Stormwater
Best Management Practices Manual. In your resubmittal, please provide one completed
Level Spreader Supplement Form for each proposed level spreader (make sure to include
the Required Items Checklist with all required items attached). The BMP Manual and Level
Spreader Supplement Forms are available at: http://h2o.enr.state.nc.us/su/bmp forms.htm.
On January 22, 2008, we met with Annette Lucas to discuss this request item. As a
result of this meeting in addition to the fact that detention basin #3 is located within a
phase of the plan that did not require the review and approval of the NC Division of
Water Quality, Mrs. Lucas is not requiring any additional information for the level
spreader at detention basin #3. Additionally, because detention basin #6 is
conveying offsite drainage in addition to the steep slopes that would prevent the
proper design/construction of a level spreader in this location, Mrs. Lucas and Mrs.
Karoly removed the requirement of a level spreader in this location.
For the level spreaders in sequence with detention basins #4 and 5, supplemental
forms, required items checklists, signed/notarized Inspection & Maintenance
Agreements, signed/notarized deed restrictions along with level spreader and pre-
formed scour hole location photographs are included for your review.

2. If any of the filter strips down slope of wet detention basins 3, 4, 5 or 6 are not appropriate
for level spreaders, then please provide an alternative BMP that removes a minimum of
30% of total nitrogen. Please design the BMP per the requirements of the BMP Manual and
provide a BMP Supplement Form for each proposed BMP. See the website above for the
BMP Manual and the BMP Supplement Forms.

process requested for the written concurrence of Water Quality Certifications 3699 & 3704 and

Filter Strip, Restored Riparian Buffer and Level Spreader
Inspection and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMW elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.
Important maintenance procedures:
- Immediately after the filter strip is established, any newly planted vegetation
will be watered twice weekly if needed until the plants become established
(commonly six weeks).
- Once a year, the filter strip will be reseeded to maintain a dense growth of
vegetation
- Stable groundcover will be maintained in the drainage area to reduce the
sediment load to the vegetation.
- Two to three times a year, grass filter strips will be mowed and the clippings
harvested to promote the growth of thick vegetation with optimum pollutant
removal efficiency. Turf grass should not be cut shorter than 3 to 5 inches and
may be allowed to grow as tall as 12 inches depending on aesthetic requirements
(NIPC,1993). Forested filter strips do not require this type of maintenance.
- Once a year, the soil will be aerated if necessary.
- Once a year, soil pH will be tested and lime will be added if necessary.
After the filter strip is established, it will be inspected quarterly and within 24 hours
after every storm event greater than 1.0 inch (or 1.5 inches if in a Coastal County).
Records of inspection and maintenance will be kept in a known set location and will be
available upon request.

Low Density Residential Subdivisions
Deed Restrictions & Protective Covenances
In accordance with Title 15 NCAC 2H.1000, the Stormwater Management Regulations, deed restrictions
and protective covenants are required for Low Density Residential Subdivisions where lots will be
subdivided and sold. Deed restrictions and protective covenants are necessary to ensure that the
development maintains a "built-upon" area consistent with the applicable regulation governing the density
level.
1, F. Robert Ohmann acknowledge and affirm by my signature below, that I will cause the
following deed restrictions and protective covenants to be recorded for Brightwood Trails Subdivision, Ph 5
prior to the sale of any lot:
1. The following covenants are intended to ensure ongoing compliance with State Stomawater
Management Permit Number , as issued by the Division of Water Quality under
NCAC 2H.1000.
2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the stormwater management permit.
3. These covenants are to run with the land and be binding on all persons and parties claiming
under them.
4. The covenants pertaining to stormwater may not be altered or rescinded without the express
written consent of the State of North Carolina, Division of Wafer Quality.
5. Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the Division of Water Quality.
6. The maximum allowable built-upon area per Jot is 201 square feet. This allotted amount
includes any built-upon area constructed within the lot property boundaries, and that portion of the
right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but
is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does
not include raised, open wood decking, or the water surface of swimming pools.
7. In the case of a lot within CAMA's regulated AEC, where the Division of Coastal Management
calculates a different maximum allowable built-upon area for that lot than is shown herein, the
governing maximum built-upon area for that lot shall be the most restrictive of the two.
8. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings is strictly prohibited by any persons.
9. Each lot will maintain a 30 foot wide vegetated buffer between all impervious areas and surface
waters.
10. All roof drains allterminatee at least 30 foot from the mean high water mark of surface waters.

Inspection and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.
Important maintenance procedures:
- Once a year, the area around the preformed scour hoe will be reseeded if
necessary to maintain a dense growth of vegetation
- Stable groundcover will be maintained in the drainage area to reduce the
sediment load to the vegetation.
After the preformed scour hole is constructed, it will be inspected quarterly and within
24 hours after every storm event greater than 1.0 inch (or 1.5 inches if in a Coastal
County). Records of inspection and maintenance will be kept in a known set location
and will be available upon request.

Low Density Residential Subdivisions
Deed Restrictions & Protective Covenances
In accordance with Title 15 NCAC 21-9.1000, the Stormwater Management Regulations, deed restrictions
and protective covenants are required for Low Density Residential Subdivisions where lots will be
subdivided and sold. Deed restrictions and protective covenants are necessary to ensure that the
development maintains a "built-upon" area consistent with the applicable regulation governing the density
level.

prior to the sale of any lot:
9. The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number as issued by the Division of Water Quality under
NCAC 2H. 9000.
2 The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the stormwater management permit.
3. These covenants are to run with the land and be binding on all persons and parties claiming
under them.
4. The covenants pertaining to stormwater may not be altered or rescinded without the express
written consent of the State of North Carolina, Division of Water Quality.
5. Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the Division of Water Quality.
6. The maximum allowable built-upon area per lot is 2,601 square feet. This allotted amount
