When we purchased the property, it had a "General" Major Variance for the construction of a portion of a single family home in Zone 2. This variance was issued January 8, 2002 and a copy has been enclosed. in April 2006, I contacted Mr. Kyle Barnes and discussed with him the existing variance and that I would not be able to complete construction of the home prior to the expiration of the variance on January 8, 2007. Mr. Barnes informed me to submit a new application when the existing variance expired. Mr. Bames asked me to enclose with this application, a copy of the original variance and a copy of his email so the reviewer of this application would know the DWQ has "allowed impacts to this property before" and we have discussed our proposed impacts with Mr. Barnes. Also enclosed is a copy of the plot plan prepared by Dennis Fomes, PLS last revised October 14, 2005. This plan shows the proposed house location with the encroachment into Zone 2 shown. No encroachment into Zone 1 is requested. At this time, the boundary between Zone 1 and Zone 2 has been staked by Dennis Fornes and preparation of the house site has been completed. The construction of the house is not completed and a new "General" Major Variance is requested. If you have any questions or need any further information, please contact me on my mobile number at 862-266-4836. Sincerely, ~ ~ ~~ Gene Osias Enc. v ~. Please provide ari explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. The desirability of this lot lies primarily in the water view. Strict application of both Zone 1 and Zone 2 buffer would .force home location so far back from the water that view would be dramatically impaired. (2) How these difficulties or hardships result from conditions that are unique to the property involved. This lot was designed during subdivision for a home location to be 75' back from mean hi h water rior to the ado tion of t e Neuse River Bu er Rules. Setback from coastal ve etation wou orce ome site too ar from water. (3) If,economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. The value_of this particular lot and the type of home that can be built on it presume a water view from the home. This value would be greatly deminished unless a portion of the home can occur in Zone 2. No encroachment into Zone 1 is requested. Part 3: Deed Restrictions By your signature in Part 5 of this application, you certify that all structural stormwater best management practices required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot. You will have to submit a new application when the one you have expires. There should be no complications by going through this process. When you resubmit send a copy of the variance you hold now and a copy of this a-mail along with the new application and amp changes that suit your home. The review should go quick and smooth with all that information. Just as a reminder copy and send this a-mail when you resubmit in case I am not the reviewer in the future and DWQ will understand we have allowed impacts to this property before. I have your information and I will make the owner changes to the current file. If you have any further questions please let me know.
