Your additional information request dated November 3, 2006 was received by
Kevin Martin of S&EC and then forwarded to my attention.
We have contacted Ian McMillan to set up a meeting to discuss the comments and
are awaiting a meeting date. We will continue to pursue this project and this
letter is meant to inform you we do not wish to have the project withdrawn.
After our meeting we should be able to .quickly respond to your comments.

On August 25, 2006, the Division of Water Quality (DWQ) received your application dated August 26,
2006, to impact 0.365 acres of wetland (0.126 acres permanent impact, 0.239 acres temporary impact), 91
linear feet of stream (71 linear feet temporary perennial stream impacts, and 201inear feet temporary
intermittent stream impacts), and 8,155 square feet (ftz) of protected Zone 1 Neuse River basin riparian
buffer and 5,058 square feet (ft2) of protected Zone 2 Neuse River basin riparian buffer to construct the
proposed multiuse project. On September 21, 2006, the DWQ received additional information from you,
however, the DWQ .has determined that your application remains incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive the additional information requested below, we will have to move toward denial of your
application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may continue to
review your project.
Additional Information Requested:
1. It appears you are proposing to use to use existing wetlands as the forested filter strips. Please refer
to pages 78-79 of the 1999 Stormwater BMP Manual- for the design requirements of filter strips.
Additionally, please note, that if approved, the land used as filter strips must be put into permanent
preservation (in perpetuity) since it is being used as part of a stormwater treatment series. DWQ
will need a copy that the land has been recorded with the county register of deeds.
2. As previously requested, please provide a signed and notarized operation and maintenance
agreement for the level spreaders.
3. Please provide a typical construction detail for the level spreaders.
4. Please provide a planting plan for the littoral shelves of the wet ponds.

Pond No. 2 is undersized. The Surface Area to Drainage Area (SA/DA) ratio is too small, and
therefore drawndown time is too short. Please address this when you resubmit your requested
information.
6. The average depth for Pond No. 7 is very shallow (1.3 feet). Stormwater BMP Manual specifies 3
feet average depth. Please address this when you resubmit your requested information.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-
