'I'he North Carolin� Department of Transportation (NCDOT) is proposing to replace the su�ject
bridge. This bridge is a structurally deficient 25.5' L s 21' W single span timber deck on steel
beam structure. The new shucture will be a 29'4" W(spau) s 9' Ii � 45.5' L aluminum bos
culvert on a 95° skew and 0.6% slope. An off-site detour will hTndle h�affic during the
construction. The culvert invert �vill be buried one foot below tlie stream bed. Also, 2' I1 sills
with I' H s 10' 1�� notches will be added to the inlet, mid-culvert, and oudet �nd floodplain
bencl�es constructed �t the inlet and outlet. These structures should maiutain a low flow channel
morphology, hold some bedload in the culvert, and facilitate aquatic life passage through the
crossing.

Tlie North Carolina N�tur�l I Ieritage Program lists 40 species with federnl status for Hendersou
County that are known from current records or were kno�vn to occur in the county historicall}�.
The bog turUe (Gl�+plen�ps uurhlenbergii) is listed as threatened due to similarity of appearance to
the northern bog turtle. Eight species, Carolina northern flying squirrel (Glmrconi��s saGrinus
co/ornh�s), AppalTchian elktoe nuissel (�Ilnsmidonin rrrvenelinnn), swamp pink (Helonios
Grrl/ntn), small wl�orled pogonia (Isoh•ia mecleoloides), bunched en'owhead (Srigrttrn•ia
fnsciclrintn), mountain sweel pitcher plaut (Sm�racenrn jonesri), white iriselle (Si.ti.�n�inchimu
dreho�onunn), and northern long-eared bat (NL�B, lll��ous septenh•io»alis) h�ve cw�rent records
�ud �re listed as thre�lened or endangered.
The AppTlachian elktoe mussel is found in well-o�ygenated, cool-water rivers with moderate to
f�st flowing water and stable, mixed-subsh�ates of silt, sand, gravel, and/or cobble. The

Appalachian elktoe records in the region are from rel�tively large su•eams such as the French
Broad, Little, and Mills Rivers. There are no records of occw•rence in tribntaries to these rivers.
Greer Creek flo�vs into Mud Creek about I mile downstream of the bridge. Mud Creek then
flo�vs 13 miles to the French Broad River. Mud Creek is too polluted witli sediment to suppoit
mussels and Greer Creek is too small to suppoit mussels.
The terrestrial habitat in the vicinity of the bridge has been dishu�bed by the roadway and its
mTintenance, manicw•ed lawns, and mowed fields. As is typical in much of suburban Henderson
County, the ripariau habitat on Greer Creek is mostly comprisecl of turf grasses �vith scattered
shrub and tree cover.
The bridge site is only about 2,120 feet in elevation, so there is no habitlt present for tlie Carolina
northern flying squin�l.
White irisette hebitat includes mid-elevation slopes with open diy to mesic oak-hickory forest,
typically on rocky steep ten•ain with shallow soils. This plant has only been found in tlie eastern
pait of Henderson County. The ai�a ne�r the bridge is not forested and not suitable for white
irisette.
Swamp pi�ik and mountain sweet pitcher plants botl� require saturated-soil wetlands, usually bogs,
while bunched arrowhead is considered a submerged aquatic plant that is associated witli lo�v
flow seepage areas. There are isolated �vetlands in the Hendersonville area �vitltin a few miles oF
the bridge that suppo�t these plants. Ho�vever, there are no wetlands iu or near tlie project area
aud these plants were not seen along the tributaiy to Greer Creek near tlie bridge on the May 19,
2016 survey.
Small whorled pogonia occurs in open, dry, deciduous woods �vith acid soil, tliough it can also
occw• on slopes along streams. It is also known to occur in rich, mesic forest in association with
white pine ai�d rhododendron. Habitat is lacking for tl�is plant because there are no �voods near
the bridge and tlie stream is not along a slope.
NLEB are known to winter in caves and mines and, in summer, they roost on trees witli sloughing
bark a� on sh•uchves, including concrete bridges that retain lieat. The existing bridge is a low
timber structure that sliould be too cool for bat roosting. On May 19, 201G, we did not see any
evidence that bats were usiug the bridge for roosting (i.e. staining or guano). Also, there are no
caves visible near the bridge and the nea��est underground mine is over 10 miles a�vay (USGS
data). Tree removal for this project is not anticipated, but, if needed, it would be consistent with
the exemption from incidental take for NLEB as outlined in the Pinal 4(d) Rule Uecause this pa�4
of Henderson County is not considered an area of concern (i.e., there cnrrently are no Imown
hibernacula or maternity roost trees for NLEB in tlie ��egion).
The project is limited in swpe to the replacement of bridge with a culve�t on an e�isting roadway
alignmenL Erosion and sedimentation control measures will be implemented to minimize
adverse effects of the work on aquatic habitats. Habitats fa• listed species are lacking at the
project site and none of these species �vere obseived duriug field visits. For these reasons and
those discussed above, we recommend that a determination of"no effecY' on listed species apply
to tliis project.
This project was revie�ved by NCDOT's Human Environment Unit in 2012 for potential effects to
historical architechu�e and archaeology. Surveys for architechu�e and archeological resources
were not required.

NCDOT best management practices will be used to minimize and control sedimentation and
erosion. The construction forema�i will review all measures daily to ensnre erosion and
sedimentation are being effectively controlled. If tlie devices are not fimctioning as intended,
they will be replaced immediately with better fimctioning devices.
Impacts to Waters of tl�e United States
Greer Creek (DWQ Class: B) is sho�vn on the USGS topographic map as a perennial stream. The
channel is well defined and approsimately 10' wide with a substrate of silt aud sand. Greer Creek
flows into Mud Creek about 1 mile dowustream of tlie bridge. Miid C��eek then flows 13 miles to
the Frencl� Broad River. (H[IC 06010105). The French Broad River meets the definition of a
Traditional Navigable Water. Foc these reasons, we believe Greer Creek is a Relatively
Perma��eut Water and is under the jurisdiction of the U.S. Army Corps of Engineers.
Replacement of the bridge �vith an aluminum boi culvert will ��esult in impacts to waters ofthe
United States as listed in the table below.

beam bridge with a 29'4' W(span) x 9' H x 45.5' L aluminum box culvert on the existing location.

The bridge is being replaced wilh an aluminum box culvert on the same location. Sills and baffles and floodplain benches will
be added to the culvert to help retain a more natural channel morphology and to help with aquatic life passage.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanPs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

Replace Bridge no. 73 on SR 1125 (Berea Church Rd) over Left Prong Mud Creek with a 12' x l0'
reinforced concrete box culvert on existing location. Project length is approximately 500 feet. Area of
potential effects is 200 feet from each end of the bridge and 50 feet from either end of the centerline.
SUMMARY OF CULTURAL RESOURCES REVIEW

Revietiv of HPO quad maps, HPOweb GIS mapping, historic designations roster, and indexes was
conducted on 8/20/12. Based on this review, there are no existing NR, SL, LD, DE, or SS properties in
the Area of Potential Effects (APE). The CRS also reviewed Henderson County GIS and tax records
whieh yielded only one property over die age of fifty years old within the APE. According to the
property card photo, this residential building, built in 1955, does not possess enough architectural
interest or historical significance to merit consideration for eligibility to the National Register of Historic
Places (NRHP). Additionally, Bridge no. 73 is not eligible for the National Register of Historic Places
according to Ihe NCDOT Historic Bridge Survey. Thus, a survey is not required for this project.

Bridge No. 73 is south of Hendersonville, north of the Blue Ridge Mountains, and wes[ Flat Rock in the
southern portion of Graham Cou�ty, North Carolina. The project area is pbtted in the southwestern
corner of the Hendersonville USGS 7.5' topograplric quadrangle (Figure 1).
A map review and site file search was conducted at the Office of State Archaeology (OSA) on August 9,
2012. No previously recorded archaeological sites have been identified within or adjacent to the APE, but
three kno�vn sites (31H1V39, 31HN43, and 3IHN191) are within a mile radius of the bridge. In addition,
no existing National Register of Historic Places (NRHP), State Stady Listed (SL), Locally Designated
(LD), Determined Eligible (DE), or Surveyed Site (SS) properties are wi[hin or adjacent to the
�rchaeological APE. However, the Plat Rock Historic District (NRHP) is vearby. It is to the north on the
other side of SR 1123 (Little River Road). Topographic maps, USDA soil survey maps, aerial
photographs (NC One Map), and I�istoric maps (North Carolina maps website) �vere utiGzed to gage
environmental factors that may l�ave contributed to historic or prehistoric settlement within the project
limits and to assess the level of ground disturbance.
Bridge No. 73 and SR 1125 cross Greer Creek trom the northeast to southwesk The creek drains
north�vest into Mud Creek. These waterways are part of tl�e French Broad drainage basin. The APE is
primarily situated within the Greer Creek tloodplain, but a small portion at the southern end resides on
hillside slope (Figure 2). The area is mostly open consisting of pastures and fields. The road is slightly
elevated on an earthen embankment �vith a ditch in the southwest quadrant. Overall, ground disturbance
nppears minimal.
The USDA soil survey map indicates that the APE contains hvo soil types (Figure 3). The floodplain is
composed of Toxaway silt loam (To). This soil is characterized as very poorly to poorly drained and
found on nearly level landforms wilh less than 2 percent slope. It is also subject to frequent and brief
flooding with a seasonal l�igh water table at or near the surface. Dae to persistent wetness, this series is
not suitable for prehistoric or historic settlemei�t and is imlikely to yield significant deposits. A few sites,
lio�vever, have been reported on this soil throughout the county, but this is very rare witl� sites typically

being small lithic scatters or isolated finds. The second series, wlrich is found at the southern end of the
APE along tl�e hillside, is Hayesville loam (HyE). This series is well drained, but slope is steep at 15 to
25 percent. Some portions of this series are atso eroded. Generally, significant deposits are not found on
slope of 15 percent or greater. Therefore, it is unlikely for an important site to be encountered on this soil
series.
Very few archaeological investigations have been conducted in the nearby viciniry. Results are varied but
most sites were found along the western side of Mud Geek rvith three sites (31HN39, 31HN43, and
31HN 191) being reported within a mile of the bridge. Sites 31 HN39 and 3INH43 were identified by the
University of North Carolina at Chapel Hill (UNGCH) in 1966 during the Cl�erokee Archaeological
Project. This project included large-scale surveys and salvage excavations, as well as intensive
investig�tions of late prehistoric and historic Cherokee sites throughout tlie southwestern region of the
state. lt is likely tl�e cui7ent project area was inspected by LINGCH at this time, but areas that yielded no
cultural resources were not recorded. Site 31HN39 is prehistoric lithic scatter dating to an unidentified
period. It is situated along the Mud Creek floodplaiu on moderately weii drained to somewhat poorly
draiued Codoms loam (Co). The sites eligibility for the N12IiP is imassessed. Site 31HN43 is also a
prehistoric site fi�om an unidentified period, but it yielded ceramics and lithic materials. It is situated on a
higli stream terrace made up of well drained Bradson gravelly loam (BaB). Its eligibility too is
unassessed. The final site, 31NH191, was identiffed by arcl�aeologist with NCDOT during their
investigation of proposed replacement of Bridges No. 75 and 76 (TIP B-4147). This site consists of lithic
material from an unidenti5ed prehistoric period. It is situated along a low siream terrace next to Mud
Creek on �vell drained Elsinboro loam (EnB). It is recommended as ineligible for the NRHP. From this
revierv of previous investigations, it does not appear likely for any signi5cant archaeological deposits to
be within the project limits. Sites in the area are typically found along Mud Creek on dry soils with little
to no slope. Tl�e wet soils and the steep slope in the cmrent APE are not favorable for site locations.
A historic map review was also conducted. The earliest maps to depict the project area with any great
detail are the 1889 and 1907 USGS Saluda topograplvc maps (Figures 4 and 5). The 1889 map shows no
road or structures within the project area, wl�ile the 1907 map illustrates a road similar to SR ll25. The
1907 map also plots a structure to [he south, but this is well outside of tl�e APE. Subsequent historic
maps of the area provided no new or important information regarding former his[oric struchu•es. Overall,
it appears auy historic archaeological sites in the area are located outside the APE and would not be effect
by the proposed road improvements.

Tlte de5ned archaeological APE for the proposed replacement of Bridge No. 73 is located within the
Greer Creek floodplain and along the neighboring hillside slope to the south. It is u�likely intact and
significant arcl�aeological deposits will be present in tl�is area. This is primarily due to tl�e poor quality
and wet soils in the floodplain and steep slope on tl�e hillside, which are not ideal for settlement activities.
In addition, the review of historic maps suggests it is veiy unlikely £or any significant former historic
structures be to within the project limits as none are shown near the APE. As long as impacts to the
subsurface occur within the defined APE, no further archaeological work is recommended for the
replacement of Bridge No. 73 in Henderson County. If constrnction should affec[ subsurface areas
beyond the defined APE, finther archaeological consultation will be necessary.
