Heather,
I was beginning to work on the permit for this culvert and noted some errors. Please change the cover sheet eliminating
the discussion concerning one foot sills, it was decided to have no sills in the low flow barrel and 1.5 sills in the high flow
barrel. Please change the profile view to reflect the sill changes and re date the permit drawings so they are not
confused with the drawings from 5/23/2016.
In the future you do not need to include rapanos forms with a PJD request, those are reserved for final JDs only.

Brad,
Here is the revised permit application based on the comments about maintaining the channel dimensions. There is a
1.5' sill with benching on the south barrel and the north barrel's sill was removed completely. The impacts to wetlands
changed by a small amount of square feet but the overall acreage didn't change. The amount of stream impact
decreased by three If due to the final design by the Structures Unit. It showed the length of the culvert was 36', not 39'.

Please see our response to questions from the original permit package submittal.
Bridge to culvert projects cannot go through the low impact bridge replacement process, they must go through the
normal Nationwide permitting process. Please revise the cover letter accordingly.
Cover letter has been revised. Please see attached revised permit package dated 2016-5-23.
2. This project will also require written approval from DWR under NW 14/WQC 3886. Please provide information in
your cover letter authorizing DWR to debit the required permit fee for processing the application. You will also need to
send an electronic copy of the revised application to Kristi Lynn Carpenter with the Transportation Permitting Branch in
DWR at kristilynn.carpenter@ncdenr.gov <mailto:kristilynn.carpenter@ncdenr.gov> so she can process the permit fee
and assign the application a DWR project number.
Information has been included in the cover letter and Kristi Lynn Carpenter is copied on this permit package email.
Please number and date the permit drawings.
Date and sheet numbers have been added.
4. Mitigation for permanent stream impacts will be required by the Corps of Engineers. An acceptance letter from
DMS accepting responsibility for the mitigation requirements needs to be included in the permit package.
A letter from DMS has been included in the attached revised permit package dated 2016-5-23.
5. The permanent stream impacts listed on the WIS and PCN do not match. The PCN list 36 If of permanent stream
impacts whereas the WIS list 39 If of permanent stream impacts. Please correct.
The permanent stream impacts have been changed to 361f.
6. Please provide justification for the 70 If of bank stabilization proposed on this project. Based on the photos
provided and our field notes the banks appear to be well vegetated and stabile, and this impact should be avoided or
minimized.
In the immediate area of the wing construction the banks will be disturbed. In order to provide a smooth transition
from the end of the wings/culvert back to the natural top of banks, the existing banks need to 'laid back' on an
appropriate slope and stabilized with rip rap. There will also be ditch construction at the outlet of the relocated drive
which warrants rip rap stabilization.
7. Please provide justification for the wetland impacts associated with the driveway relocation. In your discussion
please, justify why the current driveway cannot be utilized and what other options for access were considered. For
example are there any other access points to this parcel or other upland alternatives?
The driveway relocation is required, due to guardrail requirements for the proposed culvert. In an effort to minimize
impacts to the surrounding wetlands, minimum length shop curved guardrail is being utilized to provide the necessary
impact protection for the proposed culvert. This allows the driveway connection to be as close to the existing driveway
location as possible, which helps to minimize the impacts to the surrounding wetlands.
Additional options were considered, such as trying to maintain the existing driveway location. This required ending the
guardrail on top of the proposed culvert, with this design a GRAU-350 guardrail anchor unit is required. The GRAU-350
anchor unit requires a breakaway post which can not be attached to the top of the box culvert. This option was
eliminated and replaced with extending the guardrail across the culvert and utilizing shop curve guardrail.
The existing driveway serves a+/- 29 Acre parcel and is one of two access points for this large track. The other access
point is located off of Wildlife Run Lane, which intersects NC 41. This existing driveway off of Wagon Ford Road serves
as the primary access point for this track and the primary access for the Potter's Hill Pumping Station.
8. Both the entry and exit pits for the waterline bore need to be moved into an uplands area. Per Sheet UC 4 both
transitional areas for the bore have wetland impacts (the impacts for the receiving pit at 13+20 are not depict on the
permit drawing but are shown on Sheet UC 4 as being inside the wetland boundary but this may be overlapped by the
proposed fill for the driveway relocation).
We have included the pit locations on the permit drawings. The entry pit has been moved into the upland area to
eliminate impact to the wetland. The receiving pit at 13+20 is within the permanent fill impacts for the relocated drive
and is not creating additional impact.
The total permanent impacts to wetland did not change but the temporary impacts were reduced from 2,431 sq.ft. to
2,106 sq. ft.

The North Carolina Department of Transportation (NCDOT) proposes to replace the existing two span (1 @
17'-5", 1@ 18'-5") reinforced concrete bridge on steel I-beams with reinforced concrete caps on timber piles.
The proposed structure will be a RCBC (2 @ 12'-0" X 6'-0") with no sill in the low flow barrel and 1.5' sill in the
high flow barrel, on the existing alignment. Traffic will follow an offsite detour during construction. The
project will result in 0.04 acres of permanent impacts to wetlands, 0.05 acres of temporary impacts to
wetlands, 106 linear feet of permanent impacts to Buck Branch, and six feet of temporary impacts to Buck
Branch. The NCDOT is proposing 212 linear feet of stream mitigation to compensate for the unavoidable
stream impacts to Buck Branch. The impacts to jurisdictional resources will result from placement of the new
culvert. Please see enclosed copies of the PCN, DMS Mitigation Letter, permit drawings, Agent Authorization
letter, USFWS concurrence, and Pre-JD for the above-referenced project. This project is due to be let for
construction in June 2016.
Please deduct the NCDWR permit fee from WBS No. 17BP.3.R.38.

The proposed culvert provides more effective hydraulic opening than the existing bridge and will be replaced in-place. The
culvert will be buried to maintain stream bedform and there will be no excavation in non-permitted jurisdictional areas. The
removal of road fill for the culvert bridge will increase the size of the opening. Promotion of sheet flow and infiltration over
stabilized banks or grassed surfaces is proposed.

the Service concurs with the bic�logical coanelusion that these three parojecfi.� rnay affect, but are
not likely tQ adversely affect the wood stork.

Ecological Engineering, LLP (Ecological Engineering) respectfully requests concurrence with the attached request
for preliminary jurisdictional determination (JD) in association with the above referenced North Carolina
Department of Transportation (NCDOT) project. Ecological Engineering is currently under contract with H.W.
Lochner to provide natural resources inventories, jurisdictional assessments, reporting and permitting support
services. The proposed Low Impact Bridge Replacement (LIBR) project is located near Beulaville, Duplin County,
NC over Buck Branch.
At your request this package is being provided to support our environmental permit documentation submittal. On
17 Sep 2013 the US Army Corps of Engineers and NC Division of Water Resources field reviewed and approved
stream and wetland delineations performed at the project site. We have attached the following information to
assist with your review:

Modified Natural Resources Technical Report containing:

1. The Corps of Engineers believes that there may be jurisdictional waters of the United States
on the subject site, and the permit applicant or other affected party who requested this
preliminary JD is hereby advised of his or her option to request and obtain an approved
jurisdictional determination (JD) for that site. Nevertheless, the permit applicant or other
person who requested this preliminary JD has declined to exercise the option to obtain an
approved JD in this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre-construction
notification" (PCN), or requests verification for a non-reporting NWP or other general permit,
and the permit applicant has not requested an approved JD for the activity, the permit applicant
is hereby made aware of the following: (1) the permit applicant has elected to seek a permit
authorization based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved JD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an approved JD could possibly result in less compensatory mitigation being
required or different special conditions; (3) that the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other general
permit authorization; (4) that the applicant can accept a permit authorization and thereby agree
to comply with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking any activity in
reliance upon the subject permit authorization without requesting an approved JD constitutes
the applicant's acceptance of the use of the preliminary JD, but that either form of JD will be
processed as soon as is practicable; (6) accepting a permit authorization (e.g., signing a
proffered individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a preliminary JD constitutes agreement that all wetlands and other
water bodies on the site affected in any way by that activity are jurisdictional waters of the
United States, and precludes any challenge to such jurisdiction in any administrative orjudicial
compliance or enforcement action, or in any administrative appeal or in any Federal court; and
(7) whether the applicant elects to use either an approved 1D or a preliminary JD, that JD will be
processed as soon as is practicable. Further, an approved JD, a proffered individual permit (and
all terms and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional
issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes
necessary to make an official determination whether CWA jurisdiction exists over a site, or to
provide an official delineation ofjurisdictional waters on the site, the Corps will provide an
approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the subject project
site, and identifies all aquatic features on the site that could be affected by the proposed

Ecological Engineering, LLP (Ecological Engineering) appreciates the opportunity to provide this synopsis
of our field investigations with regards to jurisdictional streams, wetlands and protected species at the
abovementioned bridge location in Duplin County (Figures 1 and 2). The following information will
provide background data in the case that environmental permitting (Sections 404 and/or 401) is
required for the replacement of the current bridge. This format follows summarized guidance provided
by the NC Department of Transportation's Natural Environment Section (NES), particularly Section 5.0 of
the Natural Resources Technical Report (NRTR) protocol labeled "Jurisdictional Issues." Our area of
study extended approximately 50 feet outward from the existing centerline of the roadway and several
hundred feet in either direction of the bridge. Photographs of the crossing and surrounding area are
depicted in Appendix B.
JURISDICTIONAL ISSUES
One jurisdictional stream channel and one jurisdictional wetland system were identified and delineated
within the study area. Regulatory review by Brad Shaver (US Army Corps of Engineers) and Mason
Herndon (NC Division of Water Resources) on September, 17, 2013 concurred with our findings. Figure 3
depicts the locations of these resources.
Clean Water Act Waters of the US
Bridge No. 278 (referred to as the Site or Project Site) crosses Buck Branch approximately four miles
northeast of Beulaville. Based on our site reconnaissance and evaluation, Buck Branch classifies as a
perennial, jurisdictional stream channel. According to NCDWR (2013), this creek is designated as Class C,
Sw. Class "C" waters are protected for secondary recreation, fishing, wildlife, fish consumption, aquatic
life including propagation, survival and maintenance of biological integrity, agriculture and other uses
suitable for Class C. The "Sw" designation is a supplemental classification intended to recognize those
waters which are topographically located so as to generally have low velocities and other natural
characteristics which are different from adjacent streams draining land with steeper topography.

The following table depicts jurisdictional characteristics of the surface water resource at the Project Site.
Buck Branch is designated as a warm water stream for the purposes of stream mitigation, as applicable.
US Army Corps of Engineers (USACE) and NC Division of Water Resources (NCDWR) stream evaluation
forms are included in Appendix C.
' Compensatory mitigation requirements exist only if unavoidable impacts are anticipatetl. Final discretion is with the USACE and NCDWR.
One jurisdictional wetland system was identified within the study area. This system is situated within the
floodplain of Buck Branch and occurs along both sides of the existing bridge. Wetland classification and
quality rating data are presented in Table 2. USACE wetland delineation, NCDWR wetland rating and NC
Wetland Assessment Method (NCWAM) forms are included in Appendix D.
ROW = Right of Way
Clean Water Act Permits
The proposed project has been designated as a Categorical Exclusion (CE) for the purposes of National
Environmental Policy Act (NEPA) documentation. It is anticipated that only minor impacts, if any, will be
imposed upon jurisdictional resources at the Project Site as part of the replacement of the bridge. As a
result, a Nationwide Permit (NWP) 3 will be applicable if permanent impacts to jurisdictional resources
occur. According to the USACE Final Notice, authorized March 19, 2012, this permit authorizes: (aJ the
repair, rehabilitation or replacement of any previously authorized, currently serviceable structure, or fill, or
of any currently serviceable structure or fill authorized by 33 CFR 330.3, provided that the structure or fill is
not to be put to uses differing from those uses specified or contemplated for it in the original permit or the
most recently authorized modification; (b) the removal of accumulated sediments and debris in the vicinity
of existing structures (e.g., bridges, culverted road crossings, water intake structures, etc.J and/or the
placement of new or additional riprap to protect the structure; and, (cJ temporary structures, fills, and work
necessary to conduct the maintenance activity. The USACE holds the final discretion as to what permit will
be required to authorize project implementation. If a Section 404 permit is required, then a Section 401
Water Quality Certification (WQC) from the NCDWR will also be needed.
Coastal Area Management Act Areas of Environmental Concern
Duplin County is not designated as one of the 20 coastal North Carolina counties under jurisdiction of the
Coastal Area Management Act (CAMA). Therefore, implementation of the project will not impact any CAMA
designated areas of environmental concern.

Construction Moratoria
No construction moratoria apply at this current time.
NC River Basin Buffer Rules
According to NCDWR, there are no riparian buffer rules in place for the Cape Fear River Basin. Therefore,
project implementation will not impact any designated riparian buffers.
Rivers and Harbors Act Section 10 Navigable Waters
Buck Branch is not designated by the USACE as a Navigable Water under Section 10 of the Rivers and
Harbors Act.
Wetland and Stream Mitigation
Avoidance and Minimization of Impacts
The NCDOT will attempt to avoid and minimize impacts to streams and wetlands to the greatest extent
practicable in choosing a preferred alternative and during project design. At this time, no final decisions
have been made with regard to the location or design of the preferred alternative.
Compensatory Miti�ation of Impacts
If compensatory mitigation for unavoidable impacts is required as a result of project implementation,
NCDOT will investigate potential on-site stream and wetland mitigation opportunities. If on-site
mitigation is not feasible, mitigation will be provided by NC Department of Environment and Natural
Resources Ecosystem Enhancement Program (EEP).
Endangered Species Act Protected Species
As of September 22, 2012, the US Fish and Wildlife (USFWS) lists two federally protected species as
potentially occurring in Duplin County (Table 3). A brief description of each species' habitat
requirements follows, along with the Biological Conclusion rendered based on survey results in the study
area. Habitat requirements for each species are based on the current best available information from
referenced literature and/or the USFWS.

American alli�ator
USFWS Recommended Survey Window: year round (only warm days in winter)
Habitat Description: In North Carolina, alligators have been recorded in nearly every coastal county, and
many inland counties to the fall line. The alligator is found rivers, streams, canals, lakes, swamps, and
coastal marshes. Adult animals are highly tolerant of salt water, but the young are apparently more
sensitive, with salinities greater than five parts per thousand considered harmful. The American alligator
remains on the protected species list due to its similarity in appearance to the Endangered American
crocodile.
Biological Conclusion: Not Applicable.
Suitable habitat for the American alligator is present at the project site. Field surveys were conducted on
August 28 and September 17, 2013. No alligators were observed. It is anticipated that this transient
species, if present, will shy away from construction activities associated with project implementation. A
review of NCNHP records, last updated July 2, 2013, did not list any known occurrences of this species
within one mile of the Project Site. Therefore, it is unlikely that project implementation will adversely
affect the American alligator.
Red-cockaded woodpecker
USFWS recommended survey window: year round; November-early March (optimal)
Habitat Description: The red-cockaded woodpecker (RCW) typically occupies open, mature stands of
southern pines, particularly longleaf pine, for foraging and nesting/roosting habitat. The RCW excavates
cavities for nesting and roosting in living pine trees, aged 60 years or older, and which are contiguous
with pine stands at least 30 years of age to provide foraging habitat. The foraging range of the RCW is
normally no more than 0.5 miles.
Biological Conclusion: No Effect
Suitable habitat for the red cockaded woodpecker does not exist in the study area. Forests in the study
area are comprised of a closed hardwood canopy and sub-canopy. A review of NCNHP records, last
updated on July 2, 2013, does not list any red-cockaded woodpecker occurrences within one mile of the
Project Site. Based on current site conditions, implementation of the project will not impact the RCW.
Essential Fish Habitat
Based on review of the National Marine Fisheries Service (NMFS) database, no Essential Fish Habitat
exists along the entire length of Buck Branch from its origin to its confluence with Little Limestone
Creek, approximately 1,500 linear feet downstream of the Project Site.

C. SIGNIFICANT NEXUS DETERMINATION
A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed
by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity
of a TNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of its adjacent
wetlands, has more than a speculative or insubstantial effect on the chemical, physical and/or biological integrity of a TNW.
Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow
of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent
wetlands. It is not appropriate to determine significant nexus based solely on any speci�c threshold of distance (e.g. between a
tributary and its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland lies within or
outside of a floodplain is not solely determinative of significant nexus.
