Dear. Mr. Honeycutt:
I have been trying to get up with you by phone for some time, and have not been successful. I wanted to clarify
some issues with your macrobenthos monitoring report for Privateer.
Chris Outlaw, who did the macrobenthos IDs, is not certified under the DWQ Lab Certification Program (see
http://h2o.enr.state.nc.us/esb/ATUwww/documents/lablistll 13 07.pdf).
You indicated in your letter dated January 29, 2008 that Larry Eaton of our office had given verbal approval to
use Mr. Outlaw to analyze the samples. Chris Outlaw was formerly with the City of Durham, which was formerly
certified to do macrobenthos analysis. Larry was under the impression at that time that Mr. Outlaw was working
toward certification. That does not appear to be the case, as he is still not listed as a certified lab.
From this point on, all macrobenthos monitoring reports submitted by your firm must include analyses by a
certified lab. Failure to use a certified lab will result in the return of your report and will require re-analysis by
appropriately-certified personnel.
Larry Eaton actually had e-mail correspondence with Christine Miller of your organization in October, and at that
time he explicitly stated that only.certified labs (at this point, either Dave Lenat or Wendell Pennington) are to be
used for the macrobenthos identifications.
In addition, in the future please conduct your monitoring activities in accordance with the approved restoration
plan. Failure to do so can be considered a violation of the conditions of your water quality certification.
