Keystone Park Site, Durham, Durham County, North Carolina
On behalf of the property owner, Keystone East Associates LLC, we request an appeal of the buffer
determination performed by Mr. Steve Mitchell for the Keystone Park property (NBRRO 00-273). Mr.
Mitchell met S&EC on site and determined that a feature in the northern portion of the property that is
depicted on the Durham County Soil Survey is subject to the Neuse Buffer Rule (see attached DWQ
Buffer Determination Letter). However, we believe this feature lacks the necessary indicators of an
intermittent stream channel. Therefore, werequest a re-evaluation of the feature. Please accept this letter
as an official request. We are only appealing the determination of the northern stream feature depicted on
the Durham County Soil Survey (attached). We concur with the other determinations throughout the
property. Your help in clarifying the status of this feature is greatly appreciated.

- ~ ~; .-# evaluated to determine their subjectivity to the Neuse Buffer Rule. Four features are depicted on the
' ~ `< soils map. It has been determined that two of the features are located in the Cape Fear River Basin
. ~ :. ~ and therefor not subject to the Neuse Rules. Of the two that are within the Neuse River Basin, the
~~ ~` ;northern most is subject to protection under the Neuse River Basin: Nutrient Sensitive Waters
f ~' ~ Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code
