It looks like that got left out of the permit somehow (we have been busy so it was probably our oversight). We originally
classified the stream as perennial in the PJD request (which is an attachment to the IP). In looking back through my files,
we didn't do a form below the E/P point as all work was focused on the questionable channels above that. That was an
extremely wet season, but we felt based on geomorph, hydro, and biology it would score out that high. Visits back since
then make it look more like a very strong intermittent. I really think it is borderline (the upper channel is borderline E/I,
called E, and the jurisdictional channel is borderline I/P, called P). Since the original PJD called it perennial, and the
Corps will require mitigation either way I think you can stick with the submitted call and it won't change any of our
requirements. I will be talking to Dave about doing NCSAM out there to support the evaluation and possibly reducing
his mitigation if it scores out weakly, but I think it will end up at least 1:1 if not 2:1 on his end.

Hi Phil,
I was looking over the IP for the Waste Industries expansion and I don't see anywhere in the application where the
stream is called out as intermittent or perennial. I don't have any notes in my buffer file or the appeal file regarding that
either. I need to document it in the IP to know whether DWR will require mitigation (it won't change anything for the
Permittee as they're doing mitigation regardless). Do you have a stream form you can send me for the area that will be
impacted? Or can you point me to the location in the application documents where it's specified (I'll admit, I didn't re-
read every word).
