The proposed impacts do not require written authorization from NCDWR, and the PCN is being provided as a courtesy copy. We are requesting an email from NCDWR confirming that written authorization is not required so that we have documentation for our files and submittals to Apex. The project consist of a ±0.17 acre lot (PIN 0731896918), located at 1117 Bexley Hills Bend in the Whitehall Subdivision in Apex, Wake County (Latitude: 35.72818°N; Longitude: -78.86988°W). The project is located in the Cape Fear River basin and onsite waters drain to Beaver Creek. The Water Quality Classification for Beaver Creek is WS -IV; NSW and the Stream Index Number is: 16- 41-10-(0.5). The cataloging unit for the site is 03030002. Proposed Project The proposed project consists of the construction of a retaining wall to support lot fill for construction of a house on Lot 57. Currently, the slope at the rear of the lot is too severe to construct a house. Project History A previous wetland delineation was conducted in the early 2000's during the design of the subdivision. However, WR was unable to obtain a copy of the approved delineation or Corps AID number for the project. Additionally, the Applicant has owned the property since the Whitehall Subdivision was designed, and is not aware of any 404/401 permits required for construction of the subdivision. Onsite wetlands were delineated by WithersRavenel on 04/05/16, which were consistent with the previous wetland delineation. Additionally, Lot 57 in excess of 100ft from Beaver Creek, and the proposed project will not result impacts to Jordan Lake Riparian Buffers. Proposed Impacts The proposed impacts consist of 0.02 acres of permanent wetland impacts for construction of a retaining wall to stabilize lot fill for construction of a house on Lot 57. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts have been minimized to only those impacts necessary to construct the retaining wall and fill in order to make the lot buildable. Currently, the slopes on the rear of the lot are too steep to construct a house without a retaining wall to stabilize lot fill. Mitigation Permanent wetland impacts are less than 0.10 acres, and therefore mitigation is not proposed. WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any occurrences of endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any federally protected species known to occur in Wake County, except for the Northern Long Eared Bat. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. Since the entire project area consists of mature forest over 3" DBH, there is potential northern long eared bat habitat present. The USFWS Final 4(d) rule for the Northern Long -Eared bat specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft - radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, the lot has been cleared of all vegetation, and the ±0.02 acres of forested wetland to be filled is not considered to be substantial enough to constitute a potential impact to NLEB habitat. Therefore, WR concludes that the project will have "No Effect" on the northern long-eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
