This would be at least 3 separate instances where fill has been placed in wetlands without a permit/or in violation of permit conditions, including areas that have been identified and surveyed on a plat as part of previous permit reviews. Depending on the severity and extent of the issue, we will consider any number of options on this matter, including but not limited to referral to EPA or DOJ, USACE Civil Penalties for violation of previous permit(s), and possible revocation of his existing permit. Please be reminded that we are currently processing a permit for wetland fill on his property and at the very least I plan to suspend that review process until this matter is fully resolved. If this is a violation, we are going to suspend the processing of his permit until it is resolved. If he does not comply, then I plan to revoke his previous permit for work on the site.
