1. That on the 30th day of August, 1991, plaintiff, Mecklenburg
County, pursuant to the provisions of Chapter 40A of the General
Statutes, instituted the above -captioned civil action in the Superior
Court of Mecklenburg County to acquire by condemnation the real property
interest hereinafter described.
2. That the above-named defendants are the persons the plaintiff is
informed and believes may have or claim to have an interest in the
property.
3. The following matters are set forth in Exhibit A attached hereto
and made a part hereof: paragraph I, a description of the entire tract
or tracts of land Affected by the taking; paragraph II, a statement of
the property taken for public use; and paragraph III, a description of
the area taken.

EXHIBIT A
I. General Description of Entire Tract Affected by Taking:
Tax parcels 113-053-011, 113-053-12 and 113-053-13, being a
parcel of approximately 1.125 acres; a parcel of approximately
13.48 acres; and a parcel of approximately 3,000 square feet
(reversionary interest) respectively in Berryhill Township,
Mecklenburg County, North Carolina.
II. Statement of Property Taken:
Fee Simple Absolute as to parcels 113-053-11 and 113-053-12; and
Reversionary Interest as to parcel 113-053-13.
III. Specific Description of Property Taken:
All that certain lot or parcel of land, situate, lying and being
in Berryhill Township, Mecklenburg County, North Carolina more
particularly bounded and described as follows:
BEGINNING at a point, said point being in the centerline of
Wilkinson Boulevard (U.S. Hwy 29), said point being the common
westerly corner of Lots 1 and 2 of property of S.A. Berryhill
Estate as same is shown on a map thereof recorded in Map Book 4
at Page 303 in the Mecklenburg Public Registry; and running
thence with the said center line of Wilkinson Boulevard with the
arc of a circular curve to the right having a radius of 3,458.00
feet and an arc distance of 631.93 feet, said arc having a chord
bearing of S 66-18-19 E and a distance of 631.05 feet to a point;
running thence N 73-49--11 W 96.05 feet to a point, said point
being in the northwesterly corner of lands of Mecklenburg County
as same is described by deed recorded in Book 6331 at Page 1757
in said registry; running thence with the westerly bounds of said
lands of Mecklenburg County the following five courses and
distances: 1) S 09-42-48 E 130.61 feet to a concrete monument;
2) S 01-33-37 E 124.77 feet to an iron pin; 3) S 04-23-07 E
212.37 feet to an iron pin; 4) S 10-05-19 W 123.72 feet to an
iron pin; and 5) S 06-21-29 W 157.93 feet to an iron pin in a
stump, said iron pin being in the northerly line of lands of
Mecklenburg County as same is described by Tract Three in deed
recorded in Book 6330 at Page 1470 in said registry; running
thence with said northerly line of lands of Mecklenburg County
the following four (4) courses and distances: 1) S 87-29-33 W
136.95 feet to an iron pin; 2) N 85-01-54 W passing an iron pin
at 140.30 feet a Lotal distance of 260.49 feet to an iron pin in
a stump; 3) N 85-18-54 W passing an iron pin at 80.12 feet a
total distance of 160.06 feet to an iron pin; and 4) N 66-21-00 W
passing an iron pin at 21.09 feet and at 195.29 feet a total
distance of 288.69 feet to a concrete monument, said concrete
monument being in the common bounds of said Tract Three of lands
of Mecklenburg County, as described in Tract Two in said Book
6330 at Page 1470 in said registry, and the lands herein
described; running thence with the easterly margin of lands of
Mecklenburg County as described in said Tract Two, N 06-35-56 E
322.70 feet to an iron pin; said pin being in the easterly bounds
of lands of Crescent Resources, Inc. as same is described by deed
recorded in Book 3146 at Page 165 in said registry and designated
as CAT --248 in said deed; running thence with said easterly bounds
of lands of Crescent Resources, Inc. the following three (3)
courses and distances: 1) N 31-43-09 E 211.03 feet to an iron
pin; 2 ) N 41-59-06 E 91.70 feet to an iron pin; and 3) N 09-15-25
E 199 .9 2 feet to an existing "X" mark; running thence S 73-51-45
E 61.37 feet to an existing "X" mark; running thence N 22-24-15 E
83.15 feet to a point in the center line of Wilkinson Boulevard,
said point being the point and place of Beginning and containing
13.48 acres as same is shown on a survey by R.B. Pharr &
Associates, P.A. dated 11/2/90 to which reference is hereby made.

Will Book 29 at Page 107 in the office of the Clerk for Superior
Court of Mecklenburg County; and deeds recorded in Book 4313 at
Page 776, Book 4334 at Page 221, Book 4447 at Page 511 and Book

There is specifically included in this Condemnation that right of
reversion retained by J.C. Thompson and wife Bess 0. Thompson in
and to that 20 by 150 foot parcel conveyed to the State Highway
and Public Works Commission by instrument recorded in Book 1587
at Page 171 in the Mecklenburg Public Registry.
